The Civil Procedure Act 1997 (Commencement No.2) Order 1999

Made

The Lord Chancellor, in exercise of the powers conferred on him by section11 (2) of the Civil Procedure Act 19971 hereby makes the following Order–

This Order may be cited as the Civil Procedure Act 1997 (Commencement No.2) Order 1999.

In this Order–

a

“the 1981 Act” means the Supreme Court Act 19812; and

b

“the 1984 Act” means the County Courts Act 19843.

Section 10 (minor and consequential amendments) of the Civil Procedure Act 1997 shall come into force on 26th April 1999 so far as it relates to the following entries in Schedule 2–

a

paragraph 1(3) (amendment of section 68 of the 1981 Act);

b

paragraph 1(4)(a), (b) and (d) (amendment of section 84 of 1981 Act);

c

paragraph 1(5) (omission of section 85 of the 1981 Act);

d

paragraph 1(6) (amendment of section 87 of the 1981 Act);

e

paragraph 1(7) (amendment of section 151 of the 1981 Act);

f

paragraph 2(3) (amendment of the 1984 Act);

g

paragraph 2(6) (omission of section 75 of the 1984 Act);

h

paragraph 2(7) (amendment of section 77 of the 1984 Act);

i

paragraph 2(8) (amendment of section 81 of the 1984 Act);

j

paragraph 2(9) (amendment of section 147 of the 1984 Act); and

k

paragraph 4(b) (amendment of section 40 of the Matrimonial and Family Proceedings Act 19844).

This Order brings into force on 26th April 1999 those provisions of the Civil Procedure Act 1997 which are not already in force.
