The amendments made are as follows:— PART V APPROVED TRAINING COURSES FOR RIDERS OF MOTOR BICYCLES AND MOPEDS<Emphasis>Approved training courses</Emphasis> Provision of approved training courses581For the purposes of section 97(3)(e) of the Traffic Act an approved training course is a course for riders of motor bicycles or mopeds both complying with and conducted in accordance with this Part of these Regulations and approved by the Secretary of State.2An approved training course may be provided—aby the Secretary of State, in so far as concerns the instruction of persons in the civil service of the Crown under his department,bby the Secretary of State for Defence, in so far as concerns the instruction of persons in the service of the Crown under his department, andcby any chief officer of police, in so far as concerns the instruction of—imembers of the police force of which he is the chief officer, oriipersons employed in the driving of motor vehicles for police purposes by the chief officer or by the police authority or local policing body for the area in respect of which he is the chief officer,if that person satisfies the conditions mentioned in paragraph (4).3A person may apply to the Secretary of State to be authorised to provide approved training courses and the Secretary of State may give such authorisation subject to any conditions which he thinks fit to impose if he is satisfied that the applicant satisfies the conditions mentioned in paragraph (4).4The conditions specified in paragraphs (2) and (3) are that he—ais a fit and proper person to conduct courses,bwill make proper arrangements for the conduct of courses in accordance with these Regulations, andcwill keep proper records of courses and the results thereof.5In this Part of these Regulations—“approved training body" means a person authorised to provide approved training courses under this Part;“approved training course" has the meaning given in paragraph (1);“prescribed training course" means a course containing the elements prescribed under the regulation 59. Nature and conduct of training courses591A training course for riders of motor bicycles and mopeds may not be approved by the Secretary of State unless it comprises elements (A) to (E) set out in Schedule 12.2Before any practical instruction is given to riders on an approved training course all the requirements of element (A) of the course must be fulfilled.3To complete an approved training course successfully, a rider of a motor bicycle or moped must satisfy the approved training body or a certified instructor acting on his behalf as to each of the following matters in the following sequence—athat he has fulfilled the requirements set out in element (B) of the course; andbthat he can execute the manoeuvres set out in element (C) of the course; andcthat all the requirements of element (D) of the course have been fulfilled; anddthat he rides safely on roads in a variety of road traffic situations, including as many as practicable of those set out in element (E) of the course.<Emphasis>Instructors</Emphasis> Certified Instructors601No person may conduct instruction in the riding of motor bicycles or mopeds as part of an approved training course except in accordance with this regulation and regulations 60A to 68.2Subject to the following provisions of this regulation, an approved training body may authorise persons to conduct on his behalf instruction of persons in the riding of A1 motorcycles and mopeds.3A person may not be authorised under paragraph (2) unless at the date of authorisation he satisfies the following conditions, namely that—ahe is a fit and proper person to be an instructor;bhe holds a full licence authorising the driving of vehicles in category A other than A1 motorcycles;ceither—iin the case of a person who was authorised to conduct instruction by an approved training body in accordance with regulations in force on 30th January 1998, he had held that licence for a period of, or periods amounting in aggregate to, not less than two years, oriiin any other case, he is at least 21 years of age and has held that licence for a period of, or periods amounting in aggregate to, not less than three years; anddhe has either—isuccessfully completed the Secretary of State’s assessment course for certified instructors, oriibeen fully trained by a certified instructor who has successfully completed such a course and assessed by that instructor to be capable of acting as a certified instructor.3AA person does not have to satisfy the conditions mentioned in paragraph (3)(c) and (d) if that person is entitled to give paid instruction in the riding of A1 motorcycles and mopeds by virtue of Part 3 of the European Union (Recognition of Professional Qualifications) Regulations 2015 .4An authorisation given to a person under paragraph (2) shall be of no effect unless—athe approved training body has notified the Secretary of State in writing of the proposed authorisation,bthe Secretary of State has approved the authorisation in writing, andcthere is in force in respect of that person a valid certificate, in the form set out in Part 1 of Schedule 13, issued by the Secretary of State to the approved training body giving the authorisation.5A person in respect of whom a certificate issued under paragraph (4)(c) is in force—ashall be known as a certified instructor, andbshall be entitled to conduct approved training courses, andcin the case of a person who has successfully completed the Secretary of State’s assessment course for certified instructors, shall be entitled to train other persons and to assess their capability to act as certified instructors.6Where a person who is an approved training body satisfies the conditions set out in paragraph (3), the Secretary of State may issue a certificate in respect of him under paragraph (4)(c) and while that certificate is in force—ahe shall be known as a certified instructor,bhe shall be entitled to conduct approved training courses, andcin the case of a person who has successfully completed the Secretary of State’s assessment course for certified instructors, he shall be entitled to train other persons and to assess their capability to act as certified instructors.7A certificate issued pursuant to paragraph (4)(c) shall be valid for a period of four years but may be renewed upon application being made to the Secretary of State by the approved training body who authorised the instructor.8When conducting an approved training course a certified instructor shall carry with him the certificate issued in respect of him by the Secretary of State and shall, upon being required to do so by a constable or the Secretary of State, produce it for examination.9In this Part of these Regulations “certified instructor" has the meaning given in paragraph (5)(a) or (6)(a) as the case may be , and includes a person in respect of whom there is in force a valid certificate issued under regulation 60A(3)(c).<Addition ChangeId="key-8901bd8d7341832ea3888a695be5d6cc-1613146802567" CommentaryRef="key-8901bd8d7341832ea3888a695be5d6cc">Temporary certified instructors</Addition>60A1Subject to paragraph (3), an approved training body may authorise a person who satisfies the condition set out in paragraph (2) to conduct on his behalf instruction of persons in the riding of A1 motorcycles and mopeds.2The condition referred to in paragraphs (1) and (5) is that the person has made a declaration to the Secretary of State or to the appropriate Northern Ireland officer, in accordance with regulations 15 and 16 of the European Union (Recognition of Professional Qualifications) Regulations 2015, that entitles the person to give paid instruction in the United Kingdom in the riding of A1 motorcycles and mopeds on a temporary and occasional basis.3An authorisation given to a person under paragraph (1) shall be of no effect unless—athe approved training body has notified the Secretary of State in writing of the proposed authorisation,bthe Secretary of State has approved the authorisation in writing, andcthere is in force in respect of that person a valid certificate, in the form set out in Part 4 of Schedule 13, issued by the Secretary of State to the approved training body giving the authorisation.4A person in respect of whom a certificate issued under paragraph (3)(c) is in force —ashall be known by the official title used in the State that is the person’s home State for the purposes of the European Union (Recognition of Professional Qualifications) Regulations 2015,bshall be entitled to conduct approved training courses, andcin the case of a person who has successfully completed the Secretary of State’s assessment course for certified instructors, shall be entitled to train other persons and to assess their capability to act as certified instructors.5Where a person who is an approved training body satisfies the condition set out in paragraph (2), the Secretary of State may issue a certificate in respect of that person under paragraph (3)(c) and while that certificate in is force he or she—ashall be known by the official title used in the State that is the person’s home State for the purposes of the European Union (Recognition of Professional Qualifications) Regulations 2015,bshall be entitled to conduct approved training courses, andcin the case of a person who has successfully completed the Secretary of State’s assessment course for certified instructors, shall be entitled to train other persons and to assess their capability to act as certified instructors.6A certificate issued pursuant to paragraph (3)(c) shall be valid for a period of one year from the date the declaration under regulation 15 of the European Union (Recognition of Professional Qualifications) Regulations 2015 is made, but may be renewed upon application being made to the Secretary of State by the approved training body who authorised the instructor, or who is the instructor, where the instructor has renewed his or her declaration within one year of being made in accordance with regulations 15 and 16 of those Regulations.7A certificate issued pursuant to paragraph (3)(c) ceases to be valid if the instructor ceases to be entitled under Part 2 of the European Union (Recognition of Professional Qualifications) Regulations 2015 to give paid instruction in the riding of A1 motorcycles and mopeds on a temporary and occasional basis.8Where a certificate issued pursuant to paragraph (3)(c) ceases to be valid the instructor must as soon as reasonably practicable return the certificate issued under paragraph (3)(c) and all forms of certificates which were supplied to that person under regulation 68(3) to the approved training body who gave the authorisation who must, on receiving the certificate issued under paragraph (3)(c), return it to the Secretary of State.9When conducting an approved training course an instructor must carry with him or her the certificate issued in respect of that person under paragraph (3)(c) and must, upon being required to do so by a constable or the Secretary of State, produce it for examination.10In this regulation and regulation 65A “appropriate Northern Ireland officer” means the officer referred to in Article 51(2) of the Road Traffic (Northern Ireland) Order 2007 . Persons authorised as assistant instructors611Subject to paragraphs (2) and (3), a person authorised or deemed to be authorised as an assistant instructor by virtue of regulations in force on 30th January 1998 shall be entitled to conduct, on behalf of an approved training body, the instruction of riders of motor bicycles in all elements other than element (E) of the prescribed training course.2No person authorised or deemed to be authorised as an assistant instructor may conduct instruction if at any time he ceases to hold a full licence authorising the driving of vehicles in category A (other than a licence authorising the driving only of A1 motorcycles) or if the Secretary of State, being satisfied that he is not a fit and proper person to conduct instruction, withdraws approval of his authorisation to act as an assistant instructor.3No person shall be entitled to conduct training otherwise than as a certified instructor or certified direct access instructor after 30th January 2002. Withdrawal of approval to provide training courses or to act as instructo r621The Secretary of State may at any time by notice in writing withdraw an authorisation given under regulation 58(3), an approval given under regulation 60(4)(b) or 60A(3)(b), or an authorisation granted by virtue of regulation 61(1).2Where the Secretary of State withdraws an authorisation given under regulation 58(3)—athe approval of that person for the purposes of that regulation, andbthe authority of that person, and of any other person whom he has approved to act as a certified or assistant instructor,shall cease forthwith and the person whose approval is withdrawn shall, before the expiration of a period of 28 days commencing on the date of withdrawal, return to the Secretary of State all certificates which were issued to him under regulation 60(4)(c) and all forms for certificates which were supplied to him under regulation 68(3).3Where the Secretary of State withdraws an approval given under regulation 60(4)(b) or 60A(3)(b) or an authorisation granted by virtue of regulation 61(1)—athe authority of the person whose approval to act (as the case may be) as a certified or assistant instructor is withdrawn shall cease forthwith, andbin the case of the withdrawal of an approval given in respect of a certified instructor, the person whose approval is withdrawn shall as soon as is reasonably practicable return the certificate issued under regulation 60(4)(c) or 60A(3)(c) and all forms of certificates which were supplied to him under regulation 68(3) to the approved training body who authorised him who must, on receiving the certificate issued under regulation 60(4)(c) or 60A(3)(c), return it to the Secretary of State. Cessation of conduct of training631Where a certified instructor authorised by an approved training body under regulation 60(2) or 60A(1) ceases to conduct instruction on behalf of the body who authorised him, he shall as soon as is reasonably practicable return the certificate issued under regulation 60(4)(c) or 60A(3)(c) and all forms of certificates which were supplied to him under regulation 68(3) to the approved training body who must, on receiving the certificate issued under regulation 60(4)(c) or 60A(3)(c), return it to the Secretary of State.2Where an approved training body who is also entitled under regulation 60(6) or 60A(5) to conduct instruction as a certified instructor ceases to conduct such instruction, he shall immediately return the certificate issued under regulation 60(4)(c) or 60A(3)(c) and (unless the Secretary of State agrees otherwise) all forms of certificates which were supplied to him under regulation 68(3) to the Secretary of State. Approved training courses conducted <Substitution ChangeId="key-5d17893321772af39cdd52a04fe8313d-1605631057173" CommentaryRef="key-5d17893321772af39cdd52a04fe8313d">by certified direct access instructors</Substitution> 641An approved training course for a person holding a provisional licence authorising the driving of A2 motorcycles or A3 motorcycles and undertaken by him on an A2 motorcycle or an A3 motorcycle, as appropriate must be conducted by a certified direct access instructor.2“Certified direct access instructor" means a person authorised (or deemed to have been authorised) in accordance with regulation 65 or 65A. Certified direct access instructors651An approved training body may, subject to the following provisions of this regulation, authorise instructors to conduct on his behalf the instruction of persons who hold provisional licences authorising the riding of A2 motorcycles or A3 motorcycles in the riding of A2 motorcycles or A3 motorcycles, as appropriate.2A person may not be authorised under paragraph (1) unless he—aholds a full licence to drive motor bicycles,beither—iwas authorised on 30th January 1998 to conduct instruction by an approved training body in accordance with the Motor Vehicles (Driving Licences) Regulations 1996 and has held that licence for a period of, or periods amounting in aggregate to, not less than 2 years, oriiif he was not so authorised, is at least 21 years of age and has held that licence for a period of, or periods amounting in aggregate to, not less than 3 years.cis a certified instructor, anddhas successfully completed the Secretary of State’s assessment course for certified direct access instructors.3An authorisation given under paragraph (1) shall be of no effect unless—athe person whom the approved training body proposes to authorise, or another person who is at that time validly authorised by the approved training body to provide instruction in the riding of motor bicycles other than A1 motorcycles, has successfully completed the Secretary of State’s assessment course for certified instructors in addition to the assessment course for direct access instructors,bthe approved training body has notified the Secretary of State in writing of the proposed authorisation, andcthe Secretary of State has approved the authorisation in writing.3AA person does not have to satisfy the conditions mentioned in paragraph (3)(c) and (d) if that person is entitled to give paid instruction in the riding of A1 motorcycles and mopeds by virtue of Part 3 of the European Union (Recognition of Professional Qualifications) Regulations 2015.4An authorisation given under paragraph (1) shall be of no effect in the case of a direct access instructor unless there is in force in respect of him a valid certificate, in the form set out in Part 2 of Schedule 13, issued by the Secretary of State to the person who has authorised him under paragraph (1).5The Secretary of State may at any time by notice in writing withdraw an approval given under paragraph (3)(c) and any authorisation given under paragraph (1) shall cease to have effect from the date of such notice.6Any authorisation given under paragraph (1) by an approved training body shall cease to have effect if at any time there ceases to be a person who—ais validly authorised by that approved training body to conduct instruction in accordance with paragraph (1), andbhas successfully completed the Secretary of State’s assessment course for certified instructors in addition to the assessment course for direct access instructors.7Where—aa person who is an approved training body satisfies the conditions set out in paragraph (2),beither he or another person who is at that time validly authorised by him to provide instruction in the riding of motor bicycles other than A1 motorcycles has successfully completed the Secretary of State’s assessment course for certified instructors in addition to the assessment course for direct access instructors, andcthere is in force in respect of that training body a valid certificate issued by the Secretary of State under paragraph (4),he shall be deemed to have been authorised under paragraph (1) as a certified direct access instructor.8Regulations 60(7) and (8), 62(3) and 63 shall apply in respect of a certified direct access instructor as they apply in respect of a certified instructor as if the references therein to the issue of certificates and the giving or withdrawal of approval were references to the issue of certificates and the giving or withdrawal of approval under this regulation.9Where an authorisation given, or deemed to be given, under this regulation in respect of a certified direct access instructor ceases to have effect by virtue of any of the foregoing provisions of this regulation that instructor shall as soon as is reasonably practicable return the certificate issued under paragraph (4) to the approved training body who must, on receiving it, return it immediately to the Secretary of State.<Addition ChangeId="key-fbf6ceaff76b37ec40e23db9889bd057-1613146844524" CommentaryRef="key-fbf6ceaff76b37ec40e23db9889bd057">Temporary certified direct access instructors</Addition>65A1Subject to paragraphs (3) and (4), an approved training body may authorise a person who satisfies the condition set out in paragraph (2) to conduct on his behalf instruction of persons who hold provisional licences authorising the riding of A2 or A3 motorcycles in the riding of A2 or A3 motorcycles, as appropriate.2The condition referred to in paragraph (1) is that the person has made a declaration to the Secretary of State or to the appropriate Northern Ireland officer, in accordance with regulations 15 and 16 of the European Union (Recognition of Professional Qualifications) Regulations 2015, that entitles the person to give paid instruction in the United Kingdom in the riding of A2 or A3 motorcycles on a temporary and occasional basis.3An authorisation given under paragraph (1) shall be of no effect unless—athe approved training body has notified the Secretary of State in writing of the proposed authorisation, andbthe Secretary of State has approved the authorisation in writing.4An authorisation given under paragraph (1) shall be of no effect unless there is in force in respect of that person a valid certificate, in the form set out in Part 5 of Schedule 13, issued by the Secretary of State to the approved training body giving the authorisation.5A person in respect of whom a certificate issued under paragraph (4) is in force —ashall be known by the official title used in the State that is the person’s home State for the purposes of the European Union (Recognition of Professional Qualifications) Regulations 2015, andbshall be entitled to conduct approved training courses for persons holding a provisional licence authorising the driving of A2 or A3 motorcycles and undertaken by them on an A2 or A3 motorcycle, as appropriate.6The Secretary of State may at any time by notice in writing withdraw an approval given under paragraph (3)(b) and any authorisation given under paragraph (1) shall cease to have effect from the date of such notice.7A certificate issued pursuant to paragraph (4) ceases to be valid if the instructor ceases to be entitled under Part 2 of the European Union (Recognition of Professional Qualifications) Regulations 2015 to give paid instruction in the riding of A2 and A3 motorcycles on a temporary and occasional basis.8Where—aa person who is an approved training body satisfies the condition set out in paragraph (2), andbthere is in force in respect of that training body a valid certificate issued by the Secretary of State under paragraph (4),he shall be deemed to have been authorised under paragraph (1).9Regulations 60A(6) and (9), 62(3) and 63 shall apply in respect of a person authorised under paragraph (1) as they apply in respect of a certified instructor as if the references therein to the issue of certificates and the giving or withdrawal of approval were references to the issue of certificates and the giving or withdrawal of approval under this regulation.10Where an authorisation given, or deemed to be given, under paragraph (1) of this regulation ceases to have effect by virtue of any of the foregoing provisions of this regulation that instructor shall as soon as is reasonably practicable return the certificate issued under paragraph (4) to the approved training body who must, on receiving it, return it immediately to the Secretary of State.<Emphasis>Miscellaneous</Emphasis> Eligibility to undertake approved training course66No person shall be eligible to undertake an approved training course unless at the time he undertakes it he holds a provisional licence authorising him to drive a motor bicycle or moped of the class on which the course is to be undertaken or is entitled, by virtue of section 98 or 99A of the Traffic Act and regulation 19, to drive a motor bicycle of that class subject to the same conditions as the holder of a provisional licence. Ratio of trainees to instructors671Where, during an approved training course, more than one person is receiving on-site instruction and practical on-site riding as part of elements (B) and (C) of the prescribed training course—ain the case of instruction or riding which may under these Regulations be conducted by a certified or an assistant instructor, there shall be no more than four such persons in the charge of any one instructor at any one time,bin the case of instruction or riding which must under regulation 64 be conducted by a certified direct access instructor, there shall be no more than two such persons in the charge of any one instructor at any one time.2Subject to paragraph (3), when riders are undertaking element (E) of the prescribed training course—athere must be no more than two riders in the charge of any one certified or certified direct access instructor at any one time, andbthe instructor must be able to communicate with each rider by means of a radio which is not hand-held while in operation.3The requirement specified in paragraph (2)(b) shall not apply in the case of a rider who is unable, by reason of impaired hearing, to receive directions from the instructor by radio where the rider and the instructor are employing a satisfactory means of communication which they have agreed before the start of element (E). Evidence of successful completion of course681The certified instructor or the certified direct access instructor who conducted element (E) of the prescribed training course shall furnish a person who successfully completes an approved training course with a certificate in the form set out in Part 3 of Schedule 13 and signed by that instructor.2A certificate under paragraph (1) is not valid either for the purposes of section 97(3)(e) of the Traffic Act or as evidence of the succesful completion of an approved training course for the purposes of regulation 38(8)—aif the person to whom it is issued is at the time of issue ineligible to undertake the training course andbafter whichever is the earliest of the following dates, namely—iin a case where the person to whom the certificate was furnished is subsequently disqualified by order of a court under section 36 of the Offenders Act, the date on which the order is made;iiin a case where the licence of the person to whom the certificate was furnished is subsequently revoked by the Secretary of State under section 3(1) of the Road Traffic (New Drivers) Act 1995, the date on which the revocation has effect in accordance with section 3(2) of that Act;iii. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .iv... the last day of the period of 2 years beginning with the date of the certificate.3A certified instructor or a certified direct access instructor shall issue certificates using forms supplied by the Secretary of State to the approved training body and the Secretary of State may make a charge of £8 per form.4An approved training body may, if satisfied that a certificate issued to a person who has successfully completed an approved training course conducted by that body has been lost or destroyed, issue a duplicate certificate but may not make a charge exceeding £20 in respect of the issue of any one certificate.5For the purposes of this regulation, a certificate furnished before 19th January 2013 in the form set out in Part 3 of Schedule 13 to these Regulations as they stood before amendment by the Motor Vehicles (Driving Licences) (Amendment) Regulations 2012 shall be regarded as a certificate under paragraph (1).<Addition ChangeId="key-ee775291293c802908c652ad4a358860-1605631295944" CommentaryRef="key-ee775291293c802908c652ad4a358860">Approved training courses before 19th January 2013</Addition>68A1A person who, before 19th January 2013, was authorised as an approved training body, or as a certified instructor, shall be treated as an approved training body or a certified instructor (as the case may be) in relation to motor bicycles or mopeds, as appropriate.2A person who, before 19th January 2013, was authorised, or deemed to be authorised, as a certified direct access instructor shall be treated as, or as being deemed to be authorised as, a certified direct access instructor in relation to motor bicycles.3A course which, before 19th January 2013, was an approved training course shall be treated as an approved training course for riders of bicycles or mopeds, as appropriate.4A certificate which, before 19th January 2013, was issued to a person referred to in paragraph (1) in the form set out in Part I of Schedule 13 shall, subject to regulation 60(7), be treated as being in force in respect of that person. Exemptions from Part V691Subject to paragraph (2), section 98(3)(c) of the Traffic Act shall not apply to a person who—apassed a test in respect of a vehicle in former category P after 30th November 1990 and before 19th January 2013, orbpasses the test for the time being prescribed in respect of category AM,and such a person shall be exempt from the requirement imposed by section 89(2A) of that Act.2Paragraph (1) shall cease to apply to a person if he is disqualified by order of a court under section 36 of the Offenders Act.2ASubject to paragraph (2C), section 89(2A) of the Traffic Act shall not apply to a person who is for the time being the holder of a full licence for a class of vehicle included in category A in respect of a test of competence to drive a vehicle of any other class included in that category.2BSubject to paragraph (2C), a person who is for the time being the holder of a full licence for a class of vehicle included in category AM or A shall be exempt from the restriction imposed by section 97(3)(e) on his driving a vehicle of any class included in category AM or A.2CThe exemptions conferred by paragraphs (2A) and (2B) shall not apply in relation to the holder of a full licence authorising him only to drive a vehicle included in category A having automatic transmission in respect of—aa test of competence to drive a vehicle having manual transmission; orbhis driving a vehicle having manual transmission.3A provisional licence or provisional entitlement holder who is resident on an exempted island shall be exempt from the requirement imposed by section 89(2A) of the Traffic Act in respect of a test of competence to drive a motor bicycle of any class taken, or to be taken, on an island, whether or not that island is an exempted island.4A provisional licence holder who is resident on an exempted island shall be exempt from the restriction imposed by section 97(3)(e) of the Traffic Act if he satisfies either of the conditions set out in paragraph (6).5Section 98(3)(c) of the Traffic Act shall not apply to a provisional entitlement holder who is resident on an exempted island if he satisfies either of the conditions set in paragraph (6).6The conditions referred to in paragraphs (4) and (5) are that he is—adriving on an exempted island, whether or not he is also resident on that island; orbdriving on an island which is not an exempted island for the purpose of—iundertaking, or travelling to or from, an approved training course,iiundergoing, or travelling to or from a place where he is to take or where he has taken, a test of competence prescribed in respect of category AM or A.7In this regulation—“exempted island" means any island in Great Britain other than—the Isle of Wight, the island which comprises Lewis and Harris, the island which comprises North Uist, Benbecula and South Uist, Mainland Orkney and Mainland Shetland, andany other island from which motor vehicles not constructed or adapted for special purposes can at some time be conveniently driven to a road in any other part of Great Britain because of the presence of a bridge, tunnel, ford or other way suitable for the passage of such motor vehicles;“provisional licence holder" means a person who holds a provisional licence which, subject to section 97(3) of the Traffic Act, authorises the driving of motor bicycles of any class; and“provisional entitlement holder" means a person who holds a full licence which is treated, by virtue of section 98 of the Traffic Act and regulation 19, as authorising him to drive motor bicycles V</Addition>69A1The Secretary of State must from time to time—acarry out a review of regulations 58 to 69,bset out the conclusions of the review in a report, andcpublish the report.2In carrying out the review the Secretary of State must, so far as is reasonable, have regard to how the Directive (to the extent to which it is implemented by these Regulations) is implemented in other member States.3The report must in particular—aset out the objectives intended to be achieved by the regulatory system established by regulations 58 to 69,bassess the extent to which those objectives are achieved, andcassess whether those objectives remain appropriate and, if so, the extent to which they could be achieved with a system that imposes less regulation.4The first report under this <Text>A person may apply to the Secretary of State to be authorised to provide approved training courses and the Secretary of State may give such authorisation subject to any conditions which he thinks fit to impose if he is satisfied that the applicant satisfies the conditions mentioned in paragraph (4).</Text>

</P2>

<Pnumber>4</Pnumber>
<P2para>
<Text>The conditions specified in paragraphs (2) and (3) are that he—</Text>

<Text>is a fit and proper person to conduct courses,</Text>

<Text>will make proper arrangements for the conduct of courses in accordance with these Regulations, and</Text>

</P3>

<Text>will keep proper records of courses and the results thereof.</Text>

<Text>In this Part of these Regulations—</Text>

<Text>“prescribed training course" means a course containing the elements prescribed under the regulation 59.</Text>

<Title> Nature and conduct of training courses</Title>

<Pnumber>1</Pnumber>
<P2para>
<Text>A training course for riders of motor bicycles and mopeds may not be approved by the Secretary of State unless it comprises elements (A) to (E) set out in Schedule 12.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/uksi/1999/2864/regulation/59/2/2017-05-08" IdURI="http://www.legislation.gov.uk/id/uksi/1999/2864/regulation/59/2" id="regulation-59-2">
<Pnumber>2</Pnumber>
<P2para>
<Text>Before any practical instruction is given to riders on an approved training course all the requirements of element (A) of the course must be fulfilled.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/uksi/1999/2864/regulation/59/3/2017-05-08" IdURI="http://www.legislation.gov.uk/id/uksi/1999/2864/regulation/59/3" id="regulation-59-3">
<Pnumber>3</Pnumber>
<P2para>
<Text>To complete an approved training course successfully, a rider of a motor bicycle or moped must satisfy the approved training body or a certified instructor acting on his behalf as to each of the following matters in the following sequence—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>that he has fulfilled the requirements set out in element (B) of the course; and</Text>
</P3para>
</P3>

<Text>that he can execute the manoeuvres set out in element (C) of the course; and</Text>

<Text>that all the requirements of element (D) of the course have been fulfilled; and</Text>

Subject to the following provisions of this regulation, an approved training body may authorise persons to conduct on his behalf instruction of persons in the riding of

<Text>A person may not be authorised under paragraph (2) unless at the date of authorisation he satisfies the following conditions, namely that—</Text>

he holds a full licence authorising the driving of vehicles in category A other than

<Text>either—</Text>

<Text>in the case of a person who was authorised to conduct instruction by an approved training body in accordance with regulations in force on 30th January 1998, he had held that licence for a period of, or periods amounting in aggregate to, not less than two years, or</Text>
</P4para>
</P4>
<P4 DocumentURI="http://www.legislation.gov.uk/uksi/1999/2864/regulation/60/3/c/ii/2017-05-08" IdURI="http://www.legislation.gov.uk/id/uksi/1999/2864/regulation/60/3/c/ii" id="regulation-60-3-c-ii">
<Pnumber>ii</Pnumber>

<Text>in any other case, he is at least 21 years of age and has held that licence for a period of, or periods amounting in aggregate to, not less than three years; and</Text>
</P4para>
</P4>

<Text>been fully trained by a certified instructor who has successfully completed such a course and assessed by that instructor to be capable of acting as a certified instructor.</Text>

<Text>An authorisation given to a person under paragraph (2) shall be of no effect unless—</Text>

<Text>the approved training body has notified the Secretary of State in writing of the proposed authorisation,</Text>
</P3para>
</P3>

<Text>the Secretary of State has approved the authorisation in writing, and</Text>

<Text>there is in force in respect of that person a valid certificate, in the form set out in Part 1 of Schedule 13, issued by the Secretary of State to the approved training body giving the authorisation.</Text>

<Text>A person in respect of whom a certificate issued under paragraph (4)(c) is in force—</Text>

<Pnumber>a</Pnumber>

<Text>shall be known as a certified instructor, and</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/1999/2864/regulation/60/5/b/2017-05-08" IdURI="http://www.legislation.gov.uk/id/uksi/1999/2864/regulation/60/5/b" id="regulation-60-5-b">
<Pnumber>b</Pnumber>

<Text>shall be entitled to conduct approved training courses, and</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/1999/2864/regulation/60/5/c/2017-05-08" IdURI="http://www.legislation.gov.uk/id/uksi/1999/2864/regulation/60/5/c" id="regulation-60-5-c">
<Pnumber>c</Pnumber>
<P3para>
<Text>in the case of a person who has successfully completed the Secretary of State’s assessment course for certified instructors, shall be entitled to train other persons and to assess their capability to act as certified instructors.</Text>
</P3para>
</P3>
</P2para>
</P2>

<Text>Where a person who is an approved training body satisfies the conditions set out in paragraph (3), the Secretary of State may issue a certificate in respect of him under paragraph (4)(c) and while that certificate is in force—</Text>

<Text>in the case of a person who has successfully completed the Secretary of State’s assessment course for certified instructors, he shall be entitled to train other persons and to assess their capability to act as certified instructors.</Text>

<Text>A certificate issued pursuant to paragraph (4)(c) shall be valid for a period of four years but may be renewed upon application being made to the Secretary of State by the approved training body who authorised the instructor.</Text>

<Pnumber>8</Pnumber>
<P2para>
<Text>When conducting an approved training course a certified instructor shall carry with him the certificate issued in respect of him by the Secretary of State and shall, upon being required to do so by a constable or the Secretary of State, produce it for examination.</Text>
</P2para>
</P2>

In this Part of these Regulations “certified instructor" has the meaning given in paragraph (5)(a) or (6)(a) as the case may be

<Text>Subject to paragraphs (2) and (3), a person authorised or deemed to be authorised as an assistant instructor by virtue of regulations in force on 30th January 1998 shall be entitled to conduct, on behalf of an approved training body, the instruction of riders of motor bicycles in all elements other than element (E) of the prescribed training course.</Text>

No person authorised or deemed to be authorised as an assistant instructor may conduct instruction if at any time he ceases to hold a full licence authorising the driving of vehicles in category A (other than a licence authorising the driving only of

Where a certified instructor authorised by an approved training body under regulation 60(2)

ceases to conduct instruction on behalf of the body who authorised him, he shall as soon as is reasonably practicable return the certificate issued under regulation 60(4)(c)

An approved training body may, subject to the following provisions of this regulation, authorise instructors to conduct on his behalf the instruction of persons who hold provisional licences authorising the riding of

<Text>A person may not be authorised under paragraph (1) unless he—</Text>

<Text>holds a full licence to drive motor bicycles,</Text>

<Text>either—</Text>

<Text>
was authorised on 30th January 1998 to conduct instruction by an approved training body in accordance with
<Substitution ChangeId="key-ef7b5a41eac18d9333a4b4f0f4673e61-1570451332021" CommentaryRef="key-ef7b5a41eac18d9333a4b4f0f4673e61">the Motor Vehicles (Driving Licences) Regulations 1996</Substitution>
and has held that licence for a period of, or periods amounting in aggregate to, not less than 2 years, or

<Text>if he was not so authorised, is at least 21 years of age and has held that licence for a period of, or periods amounting in aggregate to, not less than 3 years.</Text>

<Text>has successfully completed the Secretary of State’s assessment course for certified direct access instructors.</Text>
</P3para>
</P3>
</P2para>
</P2>

<Pnumber>3</Pnumber>

<Text>An authorisation given under paragraph (1) shall be of no effect unless—</Text>

the person whom the approved training body proposes to authorise, or another person who is at that time validly authorised by the approved training body to provide instruction in the riding of

, has successfully completed the Secretary of State’s assessment course for certified instructors in addition to the assessment course for direct access instructors,

<Text>the approved training body has notified the Secretary of State in writing of the proposed authorisation, and</Text>

</P3>

<Text>the Secretary of State has approved the authorisation in writing.</Text>

<Addition ChangeId="key-ba7a5d44173058937a38e8472d99e688-1613150816362" CommentaryRef="key-ba7a5d44173058937a38e8472d99e688">A person does not have to satisfy the conditions mentioned in paragraph (3)(c) and (d) if that person is entitled to give paid instruction in the riding of A1 motorcycles and mopeds by virtue of Part 3 of the European Union (Recognition of Professional Qualifications) Regulations 2015.</Addition>
</Text>
</P2para>
</P2>

<Pnumber>4</Pnumber>
<P2para>
<Text>An authorisation given under paragraph (1) shall be of no effect in the case of a direct access instructor unless there is in force in respect of him a valid certificate, in the form set out in Part 2 of Schedule 13, issued by the Secretary of State to the person who has authorised him under paragraph (1).</Text>
</P2para>
</P2>

<Pnumber>5</Pnumber>
<P2para>
<Text>The Secretary of State may at any time by notice in writing withdraw an approval given under paragraph (3)(c) and any authorisation given under paragraph (1) shall cease to have effect from the date of such notice.</Text>
</P2para>
</P2>

<Pnumber>6</Pnumber>
<P2para>
<Text>Any authorisation given under paragraph (1) by an approved training body shall cease to have effect if at any time there ceases to be a person who—</Text>

<Text>is validly authorised by that approved training body to conduct instruction in accordance with paragraph (1), and</Text>

<Text>has successfully completed the Secretary of State’s assessment course for certified instructors in addition to the assessment course for direct access instructors.</Text>

</P3>

</P2>

<Pnumber>7</Pnumber>

<Text>Where—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>a person who is an approved training body satisfies the conditions set out in paragraph (2),</Text>
</P3para>
</P3>

<Pnumber>b</Pnumber>

<Text>
either he or another person who is at that time validly authorised by him to provide instruction in the riding of

has successfully completed the Secretary of State’s assessment course for certified instructors in addition to the assessment course for direct access instructors, and

<P3 DocumentURI="http://www.legislation.gov.uk/uksi/1999/2864/regulation/65/7/c/2017-05-08" IdURI="http://www.legislation.gov.uk/id/uksi/1999/2864/regulation/65/7/c" id="regulation-65-7-c">
<Pnumber>c</Pnumber>
<P3para>
<Text>there is in force in respect of that training body a valid certificate issued by the Secretary of State under paragraph (4),</Text>
</P3para>
</P3>
<Text>he shall be deemed to have been authorised under paragraph (1) as a certified direct access instructor.</Text>
</P2para>
</P2>

<Pnumber>8</Pnumber>
<P2para>
<Text>Regulations 60(7) and (8), 62(3) and 63 shall apply in respect of a certified direct access instructor as they apply in respect of a certified instructor as if the references therein to the issue of certificates and the giving or withdrawal of approval were references to the issue of certificates and the giving or withdrawal of approval under this regulation.</Text>

<Pnumber>9</Pnumber>
<P2para>
<Text>Where an authorisation given, or deemed to be given, under this regulation in respect of a certified direct access instructor ceases to have effect by virtue of any of the foregoing provisions of this regulation that instructor shall as soon as is reasonably practicable return the certificate issued under paragraph (4) to the approved training body who must, on receiving it, return it immediately to the Secretary of State.</Text>

<Text>A certified instructor or a certified direct access instructor shall issue certificates using forms supplied by the Secretary of State to the approved training body and the Secretary of State may make a charge of £8 per form.</Text>

<Text>A provisional licence or provisional entitlement holder who is resident on an exempted island shall be exempt from the requirement imposed by section 89(2A) of the Traffic Act in respect of a test of competence to drive a motor bicycle of any class taken, or to be taken, on an island, whether or not that island is an exempted island.</Text>

<Text>A provisional licence holder who is resident on an exempted island shall be exempt from the restriction imposed by section 97(3)(e) of the Traffic Act if he satisfies either of the conditions set out in paragraph (6).</Text>

<Text>Section 98(3)(c) of the Traffic Act shall not apply to a provisional entitlement holder who is resident on an exempted island if he satisfies either of the conditions set in paragraph (6).</Text>

<Text>any other island from which motor vehicles not constructed or adapted for special purposes can at some time be conveniently driven to a road in any other part of Great Britain because of the presence of a bridge, tunnel, ford or other way suitable for the passage of such motor vehicles;</Text>
