In this Schedule, unless the context otherwise requires, a reference to a paragraph is a reference to a paragraph of Schedule 4 to the 1999 Act.

Subject to paragraph 3 of this Schedule—

  • paragraphs 1 to 9;

  • paragraphs 21 to 23; and

  • paragraph 24(2)

have effect in relation to appeals to the adjudicator under these Regulations.

In paragraph 6(1)(a), for the words “certificate of entitlement, entry clearance or work permit” substitute “EEA family permit, residence document or residence permit”.

For paragraph 7, substitute—

If, under the rules, leave to appeal to the Tribunal is required in cases in which an adjudicator dismisses an appeal in respect of an EEA decision which concerns a person’s entitlement to be admitted to the United Kingdom, the authority having power to grant leave must grant it if the authority is satisfied that, at the time of the decision, the appellant held an EEA family permit.

Paragraph 9 has effect only to the extent that it relates to a claim under the Human Rights Convention.

In paragraph 24(2), for the words “entry clearance” substitute “EEA family permit”, and after the words “deportation order” insert “made on grounds of public policy, public security or public health”.
