Citation, commencement and application

1.—(1) These Regulations may be cited as the Water Industry (Charges) (Vulnerable Groups) (Amendment) Regulations 2000 and shall come into force on 24th March 2000.

(2) These Regulations do not apply to any water or sewerage undertaker whose area is wholly or mainly in Wales.

Amendment of the Water Industry (Charges) (Vulnerable Groups) Regulations 1999

2.—(1) The Water Industry (Charges) (Vulnerable Groups) Regulations 1999(2) is amended as follows.

(2) In regulation 2 (special provision to be included in charges schemes), in paragraph (2)–

(a)at the beginning of sub-paragraph (a) insert “the qualifying person ”; and

(b)at the beginning of sub-paragraph (b) insert “the qualifying person, or any dependent child of that person under the age of 16 who resides in the premises,”.

(3) In regulation 3 (assistance to be provided), in paragraph (1)(b) for “ year” substitute “period”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Water Industry (Charges) (Vulnerable Groups) Regulations 1999 (“the 1999 Regulations”), which require water and sewerage undertakers' charges schemes to reflect provision for certain groups of people on low incomes who receive child benefit for three or more children or who need significantly more water because of a medical condition, and state the nature of the assistance to be provided to those groups.

Regulation 2 amends regulation 2(2) of the 1999 Regulations so as to provide assistance for households where extra water is needed for a dependent child suffering from a medical condition, and makes a minor amendment to regulation 3 of those Regulations.

The functions of the Secretary of State under section 143A were transferred, so far as exercisable in relation to any water or sewerage undertaker whose area is wholly or mainly in Wales, to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) (No. 2) Order 1999 (S.I. 1999/2787), art. 3.
