Citation, commencement and application

1.—(1) These Regulations may be cited as the School Staffing (England) (Amendment) Regulations 2003.

(2) These Regulations come into force on 17th November 2003.

(3) These Regulations apply only in relation to England.

Amendment of the School Staffing (England) Regulations 2003

2.—(1) The School Staffing (England) Regulations 2003(2) are amended as follows.

(2) In paragraph 2 of the Schedule, the following is substituted for sub-paragraph (6)—

(6) Nothing in sub-paragraphs (2) to (5) applies to a person who—

(a)has not been continuously employed at the school for the relevant period, or

(b)has failed to meet any staff qualification requirements.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the School Staffing (England) Regulations 2003 (S.I. 2003/1963), so that the transitional arrangements in the Schedule relating to the right of a person to make representations before being dismissed or ceasing to work at a school, apply to a person employed on a fixed term contract for the relevant period, currently one year.
