Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Education (Nursery Education and Early Years Development) (England) Regulations 1999.

Regulation 2(3), which comes into force on 1st April 2004, amends the minimum age in relation to which local education authorities must secure sufficient provision of nursery education for children in their area (required by section 118 of the School Standards and Framework Act 1998).

The other provisions of these Regulations, which come into force on 1st January 2004, remove the requirement to produce an Early Years Development and Childcare Plan at intervals of one year.
