The Financial Assistance for Environmental Purposes Order 2005

Coming into force

The Secretary of State, in exercise of the powers conferred upon her by section 153(4) of the Environmental Protection Act 19901, hereby makes the following Order:

Citation, extent and commencement1

This Order—

a

may be cited as the Financial Assistance for Environmental Purposes Order 2005;

b

extends to England and Wales and Northern Ireland only; and

c

shall come into force on 29th July 2005.

Variation of section 153(1) of the Environmental Protection Act 19902

In section 153(1) of the Environmental Protection Act 19902 (purposes for which financial assistance may be given), after paragraph (uu)3 there shall be added—

the scheme known as the Bio-energy Infrastructure Scheme.

This Order varies section 153(1) of the Environmental Protection Act 1990. It enables the Secretary of State, with the consent of the Treasury, to give financial assistance to, or for the purposes of, the Bio-energy Infrastructure Scheme. It extends to England, Wales and Northern Ireland only.

The purpose of the Scheme is to provide grant aid to farmers, foresters and businesses to help the development of the supply chain required to harvest, store, process and supply biomass to energy end-users.
