CIVIL PARTNERSHIP

The Civil Partnership (House of Commons Members' Fund) Order 2005

Coming into force

5th December 2005

Whereas a draft of this Order has been laid before and then approved by a resolution of each House of Parliament;

Now therefore the Leader of the House of Commons, being the Minister of the Crown designated as such by the Prime Minister and First Lord of the Treasury, in exercise of the powers conferred on him by section 255 of the Civil Partnership Act 2004(1), and having consulted such persons as he considers appropriate as required by section 255(6) of that Act, makes the following Order—

Citation and commencement

1.—(1) This Order may be cited as the Civil Partnership (House of Commons Members' Fund) Order 2005.

(2) This Order shall come into force on 5th December 2005.

Amendment to the House of Commons Members' Fund Act 1939

2.  In section 1(1) of the House of Commons Members' Fund Act 1939(2) (establishment of Fund), for “or widowers”(3) substitute “, widowers or surviving civil partners”.

Explanatory Note

(This note is not part of the Order)

This Order amends the House of Commons Members' Fund Act 1939 to extend the range of potential beneficiaries of the House of Commons Members' Fund so as to include surviving civil partners of deceased Members of the House of Commons.

A full regulatory impact assessment has not been produced for this instrument, as it has no impact on the costs of businesses, charities or voluntary bodies.

The words “or widowers” were inserted by the House of Commons Members' Fund Act 1948, s1(1), (1948 c. 36).
