Enforcement by local weights and measures authority10

Subject to paragraph (3) below, it shall be the duty of a local weights and measures authority to enforce the provisions of these Regulations within the area of the authority.

Subject to paragraph (3) below, proceedings for an offence under these Regulations shall not be instituted except by or on behalf of a local weights and measures authority.

Proceedings for an offence under regulation 16 shall not be instituted in England or Wales except by or on behalf of the Director of Public Prosecutions.

Proceedings for an offence under these Regulations, other than an offence under regulation 16, shall not be instituted after the expiration of the period of twelve months beginning with the date when the offence was committed.

Schedule 7, which confers powers on inspectors and local weights and measures authorities, shall have effect.

Nothing in these Regulations shall authorise any weights and measures authority to bring proceedings in Scotland for an offence.
