The Lord Chancellor makes the following Order in exercise of the powers conferred by section 92 of the Courts Act 2003(1).

In accordance with section 92(1) of the Courts Act 2003 he has obtained the consent of the Treasury.

In accordance with section 92(5) and (6) of the Courts Act 2003 he has consulted the Lord Chief Justice, the Master of the Rolls, the President of the Queen’s Bench Division, the President of the Family Division, the Chancellor of the High Court, the Head of Civil Justice, the Deputy Head of Civil Justice and the Civil Justice Council.

1.  This Order may be cited as the Civil Proceedings Fees (Amendment) (No.2) (Amendment) Order 2007 and shall come into force on 28th September 2007.

2.—(1) Schedule 1 in the Schedule to the Civil Proceedings Fees (Amendment) (No. 2) Order 2007(2), is amended as follows.

(2) In column 2—

(a)in fee 1.1(c), for “£60” substitute “£65”;

(b)in fee 1.1(d), for “£70” substitute “£75”;

(c)in fee 1.1(e), for “£80” substitute “£85”;

(d)in fee 1.3(c), for “£65” substitute “£60”;

(e)in fee 1.3(d), for “£75” substitute “£70”;

(f)in fee 1.3(e), for “£85” substitute “£80”.

(3) In column 1—

(a)in fee 5.2, omit the words “(excluding VAT and disbursements)”; and

(b)in fee 10, omit the heading “foreign process”.

(4) Omit fee 10.6.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Civil Proceedings Fees (Amendment) (No. 2) Order 2007 (S.I. 2007/2176 (L.16)) so as to correct mistakes in that Order.

The table below correctly sets out the fees that were incorrect in S.I. 2007/2176.

2003 c.39. Section 92 is amended by paragraphs 308 and 345 of Part 1 of Schedule 4 to the Constitutional Reform Act 2005 (c.4) from 1 October 2005 and by paragraph 4(1) and (3) of Schedule 11 to that Act from a date to be appointed.
