Use of electronic communications U.K.

31.—(1) Any requirement under or by virtue of these Regulations for a person to give a notice to another person may be met by means of an electronic communication if—

(a) it results in the information contained in that notice being available to the other person in all material respects as it would appear in a notice given in printed form; and

(b) the other person consents to the information being sent by such means.

(2) In paragraph (1), “electronic communication” has the meaning given in section 15(1) of the Electronic Communications Act 2000(1).

(3) For the purposes of paragraph (1)(a), “in all material respects” means in all respects material to an exact reproduction of the content of the information as it would appear in a notice given in printed form.

Revocations U.K.

32.  The following are revoked—

(a) the Organic Products (Imports from Third Countries) Regulations 2003(2);

(b) the Organic Products Regulations 2004(3); and

(c) regulation 2 of the Environmental Stewardship (England) and Organic Products (Amendment) Regulations 2006(4).

32A.— (1) The Secretary of State, in relation to England, must from time to time—

(a) carry out a review of these Regulations;

(b) set out the conclusion of the review in a report; and

(c) publish the report.

(2) In carrying out a review mentioned in paragraph (1) the Secretary of State must, so far as is reasonable, have regard to the powers and mechanisms available in other member States to enable the provisions of the Council Regulation, Commission Regulation 889/2008 and Commission Regulation 1235/2008 to be enforced.

(3) The report must in particular—

(a) set out the objectives intended to be achieved by the regulatory system established by these Regulations;

(b) assess the extent to which those objectives are achieved; and

(c) assess whether those objectives remain appropriate and, if so, the extent to which they could be achieved with a system that imposes less regulation.

(4) The first report under this regulation must be published before the end of the period of five years beginning with the day on which this regulation comes into force.

(5) Reports under this regulation are afterwards to be published at intervals not exceeding five years.]
