76.—(1) Amend the Crime (International Co-operation) Act 2003(1) as follows.
(2) In section 29 (hearing witnesses abroad through television links)—
(a)in subsection (1) omit “or Article 80A(4) of the Police and Criminal Evidence (Northern Ireland) Order 1989 (SI 1989/1341 (NI 12))”;
(b)after subsection (2) insert—
“(3) The Department of Justice in Northern Ireland may by order provide for Article 80A(4) of the Police and Criminal Evidence (Northern Ireland) Order 1989(2) (proceedings in which evidence may be given through television link) to apply to any further description of criminal proceedings, or to all criminal proceedings.”
(3) In section 50 (subordinate legislation)—
(a)after subsection (1) insert—
“(1A) Any power to make an order conferred by this Part on the Department of Justice in Northern Ireland is exercisable by statutory rule for the purposes of the Statutory Rules (Northern Ireland) Order 1979(3).”;
(b)in subsection (2) for “Such an order” substitute “An order made under this Part by the Secretary of State, the Treasury, the Scottish Ministers or the Department of Justice”;
(c)after subsection (5) insert—
“(6) An order made by the Department of Justice is to be subject to negative resolution (within the meaning of section 41(6) of the Interpretation Act (Northern Ireland) 1954).”
2003 c. 32. Section 29 was amended by S.I. 2005/1965 (N.I. 15). There are other amendments to the Act, but none are relevant.
