This Order is made by the Secretary of State in exercise of the powers conferred by sections 58(1) and 154(5) of the Police Reform and Social Responsibility Act 2011(1) as extended by section 26(3) of the Welsh Language Act 1993(2).
The Secretary of State has consulted the Electoral Commission about this Order in accordance with section 7(2)(hc) of the Political Parties, Elections and Referendums Act 2000(3).
In accordance with section 154(2)(b) of the Police Reform and Social Responsibility Act 2011, a draft of this Order has been approved by a resolution of each House of Parliament.
1.—(1) This Order may be cited as the Police and Crime Commissioner Elections (Welsh Forms) Order 2012.
(2) This Order comes into force on the day after the day on which it is made.
2.—(1) Each of the forms set out in the Schedule is prescribed as the form of the ballot paper which must be used at a PCC election in Wales in place of—
(a)in the case of form A, the form specified by rule 19(1)(a) of the PCC elections rules (ballot paper: three or more candidates);
(b)in the case of form B, the form specified by rule 19(1)(b) of the PCC elections rules (ballot paper: two candidates only).
(2) In paragraph (1)—
“PCC election” means an election of a police and crime commissioner in accordance with Chapter 6 of Part 1 of the Police Reform and Social Responsibility Act 2011;
“PCC elections rules” means the rules set out in Schedule 3 to the Police and Crime Commissioner Elections Order 2012(4).

The forms prescribed by article 2 of, and the Schedule to, this Order are prescribed as versions partly in Welsh and partly in English of the ballot paper which, depending on the number of candidates, must be used at elections of police and crime commissioners in Wales.
The English versions of the ballot paper are contained in the Police and Crime Commissioner Elections Order 2012 (S.I. 2012/1917).
2000 c.41. Section 7(2)(hc) was inserted by paragraphs 8 and 11 of Schedule 10 to the Police Reform and Social Responsibility Act 2011.
