The Secretary of State makes this Order in exercise of the powers conferred by sections 34(5) and 36(2) of the Justice and Security (Northern Ireland) Act 2007(1).
In accordance with section 34(3) of that Act, the Secretary of State has published a draft of the code which this Order brings into operation, has considered any representations made to her about the draft and has modified the draft in the light of those representations as she thought appropriate.
In accordance with section 36(2) of that Act, the Secretary of State is of the opinion that it is necessary by reason of urgency to make this Order without a draft having been approved by resolution of each House of Parliament.
1. This Order may be cited as the Justice and Security (Northern Ireland) Act 2007 (Code of Practice) Order 2013 and shall come into force on the day after the day on which it is made.
2. The code of practice prepared under section 34 of the Justice and Security (Northern Ireland) Act 2007 entitled “Code of Practice for the Exercise of Powers in the Justice and Security (Northern Ireland) Act 2007” and laid before Parliament on 13th May 2013 shall come into operation on the day on which this Order comes into force.

Section 34 of the Justice and Security (Northern Ireland) Act 2007 enables the Secretary of State to make codes of practice in connection with the exercise by police officers and members of Her Majesty’s forces of a power conferred by that Act. The Secretary of State has made a code of practice under section 34 which is entitled “Code of Practice for the Exercise of Powers in the Justice and Security (Northern Ireland) Act 2007” and which was laid before Parliament on 13th May 2013. This Order brings that code of practice into force. The code of practice can be downloaded from the Northern Ireland Office website.
