The Protection of Freedoms Act 2012 (Commencement No. 6) Order 2013
The Secretary of State, in exercise of the powers conferred by section 120(1) of the Protection of Freedoms Act 2012 (), makes the following Order.
Citation and interpretation
1.—(1) This Order may be cited as the Protection of Freedoms Act 2012 (Commencement No. 6) Order 2013.
(2) In this Order “the Act” means the Protection of Freedoms Act 2012.
Provisions coming into force on 17th June 2013
2. The day appointed for the coming into force of the following provisions of the Act in relation to England and Wales is 17th June 2013—
(a)section 79 (restriction on information provided to certain persons) insofar as it is not already in force;
(b)section 83 (up-dating certificates);
(c)section 115(1) (consequential amendments, repeals and revocations) insofar as it relates to the paragraphs of Schedule 9 specified in paragraph (e) below;
(d)section 115(2) (consequential amendments, repeals and revocations) insofar as it relates to the provisions of Schedule 10 specified in paragraph (f) below;
(e)the following paragraphs of Schedule 9—
(i)paragraph 108;
(ii)paragraphs 109 to 111 insofar as they are not already in force;
(iii)paragraph 113;
(iv)paragraph 118 insofar as it is not already in force;
(v)paragraphs 119 to 128;
(f)Part 6 of Schedule 10 insofar as it is not already in force.

EXPLANATORY NOTE
This Order brings into force various provisions of the Protection of Freedoms Act 2012. In particular, the Order brings into force provisions which repeal the general obligation upon the Disclosure and Barring Service (DBS) to provide a copy of a criminal record certificate to the registered body who countersigned a person’s application for such a certificate. This Order also brings into force provisions allowing for a copy of a criminal record certificate to be provided to a registered body in response to a request for such a copy.
This Order also brings into force provisions relating to the up-dating service, which introduces a procedure for the up-dating of criminal record certificates.
NOTE AS TO EARLIER COMMENCEMENT ORDERS
The following provisions of the Protection of Freedoms Act 2012 have been brought into force by commencement order made before the date of this Order.
