The Marine Navigation Act 2013 (Commencement) Order 2013

The Secretary of State for Transport makes the following Order in exercise of the powers conferred by section 13(1) of the Marine Navigation Act 2013(1).

Citation and interpretation

1.—(1) This Order may be cited as the Marine Navigation Act 2013 (Commencement) Order 2013.

(2) In this Order “the Act” means the Marine Navigation Act 2013.

Commencement of provisions on 26th June 2013

2.  26th June 2013 is the appointed day for the coming into force of sections 7 to 11 of the Act.

Commencement of provisions on 1st October 2013

3.—(1) 1st October 2013 is the appointed day for the coming into force of sections 1 to 6 of the Act, subject to paragraphs (2) and (3).

(2) On the appointed day sections 5 and 6 do not come into force in relation to fishery harbours in Wales(2).

(3) On the appointed day sections 1 to 6 do not come into force in Scotland(3).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force the provisions of the Marine Navigation Act 2013 (“the Act”).

On 26th June 2013 sections 7 to 11 come into force.

On 1st October 2013 sections 1 to 6 come into force. However, sections 1 to 6 are not commenced by this Order in respect of Scotland, as the Act provides for the Scottish Ministers to commence those sections as respects Scotland and sections 5 and 6 are not commenced by this Order in relation to fishery harbours in Wales, as the Act provides for commencement in relation to such harbours by the Welsh Ministers.

As to the exercise of powers to bring these provisions into force as respects fishery harbours in Wales, see section 13(2) of the Act.

As to the exercise of powers to bring these provisions into force in Scotland, see section 13(3) of the Act.
