EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force the powers to make coroner rules and regulations under the Coroners and Justice Act 2009 (c. 25) (“the 2009 Act”). Section 43 of the 2009 Act enables the Lord Chancellor to make coroner regulations with the agreement of the Lord Chief Justice or a judicial office holder nominated by the Lord Chief Justice. Section 45 of the 2009 Act enables the Lord Chief Justice, or a judicial office holder nominated by the Lord Chief Justice, with the agreement of the Lord Chancellor to make designated rules.

Part 1 of the 2009 Act introduces a new statutory regime for investigations and inquests into deaths. The majority of Part 1 is to be implemented in July 2013. These provisions are being commenced so that coroner rules and coroner regulations can be made shortly and brought into force at the same time as the majority of the provisions of Part 1 of the 2009 Act are brought into force.
