The Growth and Infrastructure Act 2013 (Commencement No. 3 and Savings) Order 2013

1.—(1) This Order may be cited as the Growth and Infrastructure Act 2013 (Commencement No. 3 and Savings) Order 2013.

(2) In this Order, “the Act” means the Growth and Infrastructure Act 2013.

Provisions coming into force on 1st September 2013U.K.

2.  Section 31 (employee shareholders) of the Act comes into force on 1st September 2013.

Provisions commencing on 1st October 2013 for all remaining purposesU.K.

3.  Subject to article 4, the following provisions of the Act come into force on 1st October 2013 for all remaining purposes—

(a)section 13 (declarations negativing intention to dedicate way as highway); and

(b)section 15 (registration of town or village green: statement by owner).

4.  The coming into force of section 13 of the Act has no effect in relation to any application to deposit a statement and map or lodge a statutory declaration with an appropriate council in accordance with section 31(6) of the Highways Act 1980(2) made before 1st October 2013.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force on 1st September 2013 section 31 of the Growth and Infrastructure Act 2013 (c. 27) (“the Act”). That section amends the Employment Rights Act 1996 (c. 18) in order to create the new employment status of employee shareholder.

This Order also brings into force on 1st October 2013 sections 13 and 15 of the Act, so far as those sections are not already in force.

Section 13 of the Act makes amendments to the form and procedure in England relating to statements and maps deposited and declarations lodged under section 31(6) of the Highways Act 1980 (c. 66) in order to negative an intention to dedicate a way as a highway.

Section 15 of the Act inserts new sections 15A and B into the Commons Act 2006 (c. 26) to provide for a landowner in England to deposit a statement and map for the purpose of bringing to an end any recreational use as of right on the land to which the statement relates.

In addition to making amendments to the Highways Act 1980 in relation to land in England, section 13 of the Act contains a restatement of the law as it currently applies in relation to land in Wales.

This Order also contains saving provisions relating to section 13 of the Act.
