(i)do not have the same television production company or producer as the programme that is the subject of the application; or

(ii)are derived from a previous programme that has been certified under these Regulations;

(c)if the applicant seeks to rely on regulation 5(2), the reasons why the subject matter of the documentary makes it appropriate for the Secretary of State to direct that regulation 5(1) does not apply;

(d)for the purposes of sub-paragraph (b)(i), “producer” has the same meaning as in regulation 5(3)(b).
