3.  Where section 22 of the 1995 Act M1 (circumstances in which following provisions apply) applies, a statement that at least one of the trustees of the scheme are required to be an independent person by section 23 of that Act M2.E+W+S

M2Section 23 was substituted by the 2004 Act, section 36(4).
