The Secretary of State makes the following Order in exercise of the powers conferred by section 1(1), (2) and (4) of the Protection of Wrecks Act 1973(1).

The Secretary of State is satisfied in relation to the site identified at article 2(1) of this Order of the matters set out in section 1(1) of that Act.

In accordance with section 1(4) of that Act the Secretary of State is also satisfied that this is a case in which an order should be made as a matter of immediate urgency and consultation be dispensed with.

Citation and commencement

1.  This Order may be cited as the Protection of Wrecks (Designation) (England) Order 2014 and comes into force on 21st March 2014.

Identification of site and designation of restricted area

2.—(1) This Order is made in respect of the site where a vessel lies, or is supposed to lie, at Latitude 49°51.73′ North, Longitude 006°24.50′ West(2).

(2) The area within 50 metres of the site identified in paragraph (1), excluding any part of that area above the high water mark of ordinary spring tides, is designated as a restricted area.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order designates a restricted area for the purposes of the Protection of Wrecks Act 1973 within 50 metres from the site of the wreck of the vessel “Association” lying at Gilstone Ledges, Isles of Scilly. The Secretary of State is satisfied the site ought to be protected from unauthorised interference as a matter of immediate urgency. Under section 1(3) of that Act it is a criminal offence for a person to engage in certain activities in a restricted area, except under the authority of a licence issued by the Secretary of State.

An impact assessment has not been produced for this instrument as no significant impact is foreseen on the private, voluntary or public sectors.

The co-ordinates are identified according to the World Geodetic System 1984 (WGS 84) as revised in 2004.
