The Secretary of State, in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(), being designated() in relation to the environment, having taken into account available scientific and technical data, mainly with reference to the respective nitrogen contributions originating from agricultural and other sources, and the environmental conditions of the nitrate vulnerable zones in England as required by Article 5(3) of Council Directive 91/676/EEC (concerning the protection of waters against pollution caused by nitrates from agricultural sources)() makes the following Regulations:
