Penalties71.

(1)

Subject to paragraph (2), a person guilty of an offence under regulation 70 is liable on summary conviction—

(a)

in England and Wales, to a fine or imprisonment for a term not exceeding 3 months or to both;

(b)

in Scotland and Northern Ireland, to a fine not exceeding level 5 on the standard scale or imprisonment for a term not exceeding 3 months or to both.

(2)

A person guilty of an offence under regulation 9, 13(2), 18, 23(2), 34(2) or 41(2) is liable on summary conviction —

(a)

in England and Wales, to a fine;

(b)

in Scotland or Northern Ireland, to a fine not exceeding the level 5 on the standard scale.

(1)

Subject to paragraph (2) F1and (3), a person guilty of an offence under regulation 70 is liable on summary conviction—

(a)

in England and Wales, to a fine or imprisonment for a term not exceeding 3 months or to both;

(b)

in Scotland and Northern Ireland, to a fine not exceeding level 5 on the standard scale or imprisonment for a term not exceeding 3 months or to both.

(2)

A person guilty of an offence under regulation 9, 13(2), 18, 23(2), 34(2) or 41(2) is liable on summary conviction —

(a)

in England and Wales, to a fine;

(b)

in Scotland or Northern Ireland, to a fine not exceeding the level 5 on the standard scale.

F2(3)

A person guilty of an offence under regulation 70(2) insofar as the requirement relates to a UK(NI) indication is liable on summary conviction to a fine not exceeding level 5 on the standard scale.
