Coming into force

The Secretary of State makes the following Regulations in exercise of the powers conferred by section 32(4)(b) and (6) of the Counter-Terrorism and Security Act 20151.

Citation and commencement1

These Regulations may be cited as the Counter-Terrorism and Security Act 2015 (Monitoring of Further Education Bodies) (England) Regulations 2016 and come into force on 1st August 2016.

Monitoring Authority for Relevant Further Education Bodies2

The Secretary of State delegates the function under section 32(2) of the Counter-Terrorism and Security Act 2015 to a person who has entered into a written agreement with the Secretary of State—

a

before the date these Regulations come into force; and

b

under which that person has agreed to monitor a relevant further education body’s performance in discharging the duty imposed by section 26(1) of that Act.

EXPLANATORY NOTE

(This note is not part of the Regulations)

The Counter-Terrorism and Security Act 2015 (‘the Act’) places a duty on specified authorities (which includes further education institutions) to have due regard to the need to prevent people from being drawn into terrorism. These Regulations prescribe persons to whom the Secretary of State has delegated the function of acting as a monitoring authority in respect of a relevant further education body under section 32 of the Act. A relevant further education body is defined at section 32(1) of the 2015 Act; in practice, relevant further education bodies that are not subject to inspection by the Office for Standards in Education, Children’s Services and Skills or the Higher Education Funding Council for England will be monitored by persons appointed under these Regulations.
