The Children and Social Work Act 2017 (Commencement No. 2) Regulations 2017

The Secretary of State makes the following Regulations in exercise of the powers conferred by section 70(2) and (3) of the Children and Social Work Act 20171.

Citation1

These Regulations may be cited as the Children and Social Work Act 2017 (Commencement No. 2) Regulations 2017.

Provisions coming into force on 15th January 20182

The following provisions of the Children and Social Work Act 2017 come into force on 15th January 2018—

a

section 56 (oversight by the Professional Standards Authority for Health and Social Care), so far as it relates to the provisions brought into force by paragraph (b);

b

in Schedule 4 (oversight by the Professional Standards Authority for Health and Social Care)—

i

paragraph 1, so far as it relates to paragraph 4; and

ii

paragraph 4, in so far as it inserts section 25AA(12) (funding of the Authority by Social Work England) into the National Health Service Reform and Health Care Professions Act 20022; and

c

section 58 (consultation).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations bring specified provisions of the Children and Social Work Act 2017 (c.16) (“the Act”) into force. These are the second commencement regulations made under the Act. Section 10, Schedule 1 and Part 3 of the Act came into force when the Act was passed.

Regulation 2 commences the following provisions of the Act on 15th January 2018:

  • Paragraph 4 of Schedule 4 to the Act in so far as it inserts section 25AA(12) into the National Health Service Reform and Health Care Professions Act 2002 (“the 2002 Act”). Section 25AA(12) requires the Secretary of State, before making regulations under section 25AA of the 2002 Act, to consult the Professional Standards Authority for Health and Social Care, Social Work England and such others persons as the Secretary of State considers appropriate; and

  • Section 58 of the Act, which requires, save in two instances, that the Secretary of State carry out a public consultation before making regulations under Part 2 of the Act.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
