The Pigs (Records, Identification and Movement) (Amendment) Order 2018

The Secretary of State, in exercise of the powers conferred by sections 1 and 8(1) of the Animal Health Act 1981(1), makes the following Order:

Title, application and commencement

1.  This Order may be cited as the Pigs (Records, Identification and Movement) (Amendment) Order 2018; it applies in England and comes into force on 1st June 2018.

Amendments to the Pigs (Records, Identification and Movement) Order 2011

2.—(1) The Pigs (Records, Identification and Movement) Order 2011(2) is amended as follows.

(2) In article 2 (interpretation)—

(a)omit "“BPEX” means the division of the Agriculture and Horticulture Development Board with responsibility for the pig industry in England”;

(b)after the definition of "CPH number" insert “"the database operator” means the operator nominated by the Secretary of State under article 12(A1);”.

(3) In article 12 (movement of pigs other than movements to markets or collection centres)—

(a)before paragraph 1 insert—

(A1) The Secretary of State shall nominate a person to operate a computerised central database to record movements of pigs.;

(b)in paragraph (1) for “BPEX” substitute “the database operator”;

(c)in paragraph (2)—

(i)for “BPEX”, in the first place it occurs, substitute “the database operator”;

(ii)for “BPEX movement recording system” substitute “central database”;

(d)in paragraph (3)—

(i)for “BPEX” substitute “the database operator”;

(ii)for “MLCSL”, in both places it occurs, substitute “the database operator”;

(e)in paragraph (4) for “MLCSL” substitute “the database operator”;

(f)in paragraph 5 for “BPEX” substitute “the database operator”;

(g)in paragraph 6 omit "“BPEX movement recording system” means the electronic movement recording system maintained for the purpose of notifications under this order by BPEX and”.

(4) In article 14 (Movement of pigs to markets or collection centres) for “BPEX” substitute “the database operator”.

(5) In article 16(2) (Movement of pigs from shows) for “BPEX or MLCSL” substitute “the database operator”.

(6) In article 17(2) (Transport of pigs) for “BPEX” substitute “the database operator”.

(7) In article 18 (Arrival of pigs at a holding)—

(a)in paragraph 2—

(i)in sub-paragraph (a) for “record on the BPEX pig movement system” substitute “notify the database operator electronically of”;

(ii)in sub-paragraph (b) for “MLCSL” substitute “the database operator”.

(8) In article 19 (Export of Pigs) for “MLCSL” substitute “the database operator”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Pigs (Records, Identification and Movement) Order 2011 (S.I. 2011/2154). It removes the requirement for movements to be reported to BPEX or MLCSL and replaces it with a requirement to notify movements to a person nominated by the Secretary of State.

1981 c. 22. Functions conferred under the 1981 Act on “the Minister” and “the Ministers” are now exercisable by the Secretary of State. Functions of “the Ministers” were transferred, so far as exercisable by the Secretaries of State for Scotland and Wales, to the Minister of Agriculture, Fisheries and Food by the Transfer of Functions (Agriculture and Food) Order 1999 (SI 1999/3141). Functions of the Minister of Agriculture, Fisheries and Food were then further transferred to the Secretary of State by the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002 (S.I.2002/794).
