Guardianship (missing Persons), England And Wales

The Guardianship (Missing Persons) Act 2017 (Commencement) Regulations 2019

The Secretary of State, in exercise of the powers conferred by section 25(3) of the Guardianship (Missing Persons) Act 2017(1), makes the following Regulations:

Citation

1.  These Regulations may be cited as the Guardianship (Missing Persons) Act 2017 (Commencement) Regulations 2019.

Provisions coming into force on 19th June 2019

2.  The following provisions of the Guardianship (Missing Persons) Act 2017 come into force on 19th June 2019—

(a)section 22 (codes of practice); and

(b)section 23 (the court).

Provisions coming into force on 31st July 2019

3.  Subject to regulation 2, the Guardianship (Missing Persons) Act 2017, so far as not already in force, comes into force on 31st July 2019.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations bring into force the Guardianship (Missing Persons) Act 2017 (c. 27) (“the Act”) so far as it is not already in force.

Regulation 2 brings into force, on 19th June 2019, section 22 and section 23 of the Act. Section 22 of the Act requires the Lord Chancellor to prepare and issue codes of practice including for the guidance of guardians and persons making applications to court under the Act. Section 23 of the Act provides the Lord Chancellor with the power to designate either the High Court or the Court of Protection to have the functions of the court under the Act.

Regulation 3 brings into force, on 31st July 2019, the remaining provisions of the Act which are not already in force.
