These Regulations may be cited as the Iraq (Sanctions) (EU Exit) Regulations 2020.

These Regulations come into force in accordance with regulations made by the Secretary of State under section 56 of the Act.

2Interpretation

In these Regulations—

the Act” means the Sanctions and Anti-Money Laundering Act 2018;

arrangement” includes any agreement, understanding, scheme, transaction or series of transactions, whether or not legally enforceable (but see paragraph 12 of Schedule 1 for the meaning of that term in that Schedule);

CEMA” means the Customs and Excise Management Act 1979 ;

the Commissioners” means the Commissioners for Her Majesty's Revenue and Customs;

the Committee” means the Committee of the Security Council established in accordance with paragraph 1 of resolution 1518;

conduct” includes acts and omissions;

document” includes information recorded in any form and, in relation to information recorded otherwise than in legible form, references to its production include producing a copy of the information in legible form;

the EU Iraq Regulation” means Council Regulation (EC) No 1210/2003 of 7 July 2003, concerning certain specific restrictions on economic and financial relations with Iraq and repealing Regulation (EC) No 2465/96, as it has effect in EU law;

resolution 661” means resolution 661 (1990) adopted by the Security Council on 6 August 1990;

resolution 1483” means resolution 1483 (2003) adopted by the Security Council on 22 May 2003;

resolution 1518” means resolution 1518 (2003) adopted by the Security Council on 24 November 2003;

resolution 1956” means resolution 1956 (2010) adopted by the Security Council on 15 December 2010;

trade licence” means a licence under regulation 36;

Treasury licence” means a licence under regulation 35(1);

United Kingdom person” has the same meaning as in section 21 of the Act.

3Application of prohibitions and requirements outside the United Kingdom1

A United Kingdom person may contravene a relevant prohibition by conduct wholly or partly outside the United Kingdom.

Any person may contravene a relevant prohibition by conduct in the territorial sea.

In this regulation, a “relevant prohibition” means any prohibition imposed by—

a

Part 3 (Finance),

b

Part 4 (Trade), or

c

a condition of a Treasury licence or a trade licence.

A United Kingdom person may comply, or fail to comply, with a relevant requirement by conduct wholly or partly outside the United Kingdom.

Any person may comply, or fail to comply, with a relevant requirement by conduct in the territorial sea.

In this regulation, a “relevant requirement” means any requirement imposed—

a

by or under Part 6 (Information and records), or by reason of a request made under a power conferred by that Part, or

b

by a condition of a Treasury licence or a trade licence.

Nothing in this regulation is to be taken to prevent a relevant prohibition or a relevant requirement from applying to conduct (by any person) in the United Kingdom.

4Purpose1

The purpose of the regulations contained in this instrument that are made under section 1 of the Act is compliance with the relevant UN obligations.

In this regulation, “the relevant UN obligations” means—

a

the obligation that the United Kingdom has by virtue of paragraph 23(a) of resolution 1483 (partial asset-freeze) to take the measures required by that provision in respect of persons for the time being named for the purposes of that provision by the Security Council or the Committee;

b

the obligation that the United Kingdom has by virtue of paragraph 23(b) of resolution 1483 (asset-freeze) to take the measures required by that provision in respect of persons for the time being named for the purposes of that provision by the Security Council or the Committee;

c

the obligations that the United Kingdom has by virtue of paragraph 23(b) of resolution 1483 in respect of persons—

i

acting on behalf of or at the direction of, or

ii

owned or controlled by,

the persons for the time being named by the Security Council or the Committee for the purposes of paragraph 23(b) of resolution 1483;

d

the obligations that the United Kingdom has by virtue of paragraph 3 of resolution 661 (arms embargo);

e

the obligations that the United Kingdom has by virtue of paragraph 7 of resolution 1483 (Iraqi cultural property).

<p>These Regulations come into force in accordance with regulations made by the Secretary of State under section 56 of the Act.</p>

<heading>Interpretation</heading>
<content>
<p>In these Regulations—</p>
<blockList class="unordered">

<p>
<term refersTo="#term-the-act">the Act</term>
” means the Sanctions and Anti-Money Laundering Act 2018;
</p>
</item>
<item>
<p>
<term refersTo="#term-arrangement">arrangement</term>
” includes any agreement, understanding, scheme, transaction or series of transactions, whether or not legally enforceable (but see paragraph 12 of Schedule 1 for the meaning of that term in that Schedule);
</p>
</item>
<item>
<p>
<term refersTo="#term-cema">CEMA</term>
” means the Customs and Excise Management Act 1979

<item>
<p>
<term refersTo="#term-the-commissioners">the Commissioners</term>
” means the Commissioners for Her Majesty's Revenue and Customs;

” means the Committee of the Security Council established in accordance with paragraph 1 of resolution 1518;
</p>
</item>
<item>
<p>
<term refersTo="#term-conduct">conduct</term>
” includes acts and omissions;
</p>
</item>
<item>
<p>
<term refersTo="#term-document">document</term>
” includes information recorded in any form and, in relation to information recorded otherwise than in legible form, references to its production include producing a copy of the information in legible form;
</p>
</item>
<item>
<p>
<term refersTo="#term-the-eu-iraq-regulation">the EU Iraq Regulation</term>
” means Council Regulation
<ref href="http://www.legislation.gov.uk/european/regulation/2003/1210">(EC) No 1210/2003</ref>
of 7 July 2003, concerning certain specific restrictions on economic and financial relations with Iraq and repealing Regulation

” means resolution 1956 (2010) adopted by the Security Council on 15 December 2010;

<p>
<term refersTo="#term-trade-licence">trade licence</term>
” means a licence under regulation 36;
</p>
</item>
<item>
<p>
<term refersTo="#term-treasury-licence">Treasury licence</term>
” means a licence under regulation 35(1);
</p>
</item>
<item>
<p>
<term refersTo="#term-united-kingdom-person">United Kingdom person</term>
” has the same meaning as in section 21 of the Act.

<heading>Application of prohibitions and requirements outside the United Kingdom</heading>
<paragraph eId="regulation-3-1">
<num>1</num>
<content>
<p>A United Kingdom person may contravene a relevant prohibition by conduct wholly or partly outside the United Kingdom.</p>
</content>
</paragraph>
<paragraph eId="regulation-3-2">
<num>2</num>
<content>
<p>Any person may contravene a relevant prohibition by conduct in the territorial sea.</p>
</content>
</paragraph>
<paragraph eId="regulation-3-3">
<num>3</num>
<intro>
<p>
In this regulation, a “
<term refersTo="#term-relevant-prohibition">relevant prohibition</term>
” means any prohibition imposed by—
</p>

<p>Part 3 (Finance),</p>

</subparagraph>

<num>c</num>
<content>
<p>a condition of a Treasury licence or a trade licence.</p>

<num>4</num>
<content>
<p>A United Kingdom person may comply, or fail to comply, with a relevant requirement by conduct wholly or partly outside the United Kingdom.</p>
</content>
</paragraph>
<paragraph eId="regulation-3-5">
<num>5</num>
<content>
<p>Any person may comply, or fail to comply, with a relevant requirement by conduct in the territorial sea.</p>
</content>
</paragraph>
<paragraph eId="regulation-3-6">
<num>6</num>
<intro>
<p>
In this regulation, a “
<term refersTo="#term-relevant-requirement">relevant requirement</term>
” means any requirement imposed—

<p>by or under Part 6 (Information and records), or by reason of a request made under a power conferred by that Part, or</p>

</subparagraph>

<p>by a condition of a Treasury licence or a trade licence.</p>
</content>
</subparagraph>
</paragraph>
<paragraph eId="regulation-3-7">
<num>7</num>

<p>Nothing in this regulation is to be taken to prevent a relevant prohibition or a relevant requirement from applying to conduct (by any person) in the United Kingdom.</p>

<heading>Purpose</heading>

<num>1</num>
<content>
<p>The purpose of the regulations contained in this instrument that are made under section 1 of the Act is compliance with the relevant UN obligations.</p>
</content>
</paragraph>
<paragraph eId="regulation-4-2">
<num>2</num>
<intro>
<p>
In this regulation, “
<term refersTo="#term-the-relevant-un-obligations">the relevant UN obligations</term>
” means—
</p>
</intro>
<subparagraph eId="regulation-4-2-a">
<num>a</num>
<content>
<p>
the obligation that the United Kingdom has by virtue of paragraph 23(a) of resolution 1483 (partial asset-freeze)

to take the measures required by that provision in respect of persons for the time being named for the purposes of that provision by the Security Council or the Committee;
</p>

</subparagraph>
<subparagraph eId="regulation-4-2-b">
<num>b</num>
<content>
<p>the obligation that the United Kingdom has by virtue of paragraph 23(b) of resolution 1483 (asset-freeze) to take the measures required by that provision in respect of persons for the time being named for the purposes of that provision by the Security Council or the Committee;</p>

</subparagraph>
<subparagraph eId="regulation-4-2-c">
<num>c</num>
<intro>
<p>the obligations that the United Kingdom has by virtue of paragraph 23(b) of resolution 1483 in respect of persons—</p>
</intro>

<p>acting on behalf of or at the direction of, or</p>
</content>
</clause>
<clause eId="regulation-4-2-c-ii">
<num>ii</num>
<content>
<p>owned or controlled by,</p>

<p>the persons for the time being named by the Security Council or the Committee for the purposes of paragraph 23(b) of resolution 1483;</p>

<p>the obligations that the United Kingdom has by virtue of paragraph 7 of resolution 1483 (Iraqi cultural property).</p>
