The Secretary of State makes these Regulations in exercise of the powers conferred by Articles 53(1)(b) and 57a(6) of Regulation (EC) No. 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety(1).
As required by Article 9 of Regulation (EC) No. 178/2002 there has been open and transparent public consultation during the preparation and evaluation of these Regulations.
1.—(1) These Regulations may be cited as the Food and Feed (Fukushima Restrictions) (Revocation) (England) Regulations 2022 and come into force on 29th June 2022.
(2) These Regulations extend to England and Wales, but apply in relation to England only.
2. The following retained direct EU legislation is revoked—
(a)Commission Implementing Regulation (EU) 2016/6 imposing special conditions governing the import of feed and food originating in or consigned from Japan following the accident at the Fukushima nuclear power station and repealing Implementing Regulation (EU) No 322/2014(2);
(b)Commission Implementing Regulation (EU) 2017/2058 amending Implementing Regulation (EU) 2016/6 imposing special conditions governing the import of feed and food originating in or consigned from Japan following the accident at the Fukushima nuclear power station(3);
(c)Commission Implementing Regulation (EU) 2019/1787 amending Implementing Regulation (EU) 2016/6 imposing special conditions governing the import of feed and food originating in or consigned from Japan following the accident at the Fukushima nuclear power station(4).
3. Declaration OFFC 2019/E/003, insofar as it continues to have effect by virtue of regulation 42B of the Official Feed and Food Controls (England) Regulations 2009(5), is revoked(6).

These Regulations revoke Commission Implementing Regulation (EU) 2016/6 imposing special conditions governing the import of feed and food originating in or consigned from Japan following the accident at the Fukushima nuclear power station and repealing Implementing Regulation (EU) No 322/2014; Commission Implementing Regulation (EU) 2017/2058 amending Implementing Regulation (EU) 2016/6 imposing special conditions governing the import of feed and food originating in or consigned from Japan following the accident at the Fukushima nuclear power station and Commission Implementing Regulation (EU) 2019/1787 amending Implementing Regulation (EU) 2016/6 imposing special conditions governing the import of feed and food originating in or consigned from Japan following the accident at the Fukushima nuclear power station all of which provided for enhanced controls on the import of certain feed and food from Japan as a result of the Fukushima nuclear accident.
These Regulations also revoke Declaration OFFC 2019/E/003 (please see the relevant footnote above for further details), which also imposed controls on the import of certain feed and food from Japan as a result of the Fukushima nuclear accident.

The Declaration was issued under regulation 35 of S.I. 2009/3255. However, under regulation 42B of those Regulations (as inserted by S.I. 2020/1504 and amended by a correction slip dated September 2021, ISBN 978-0-34-821708-7), the Declaration continues to have effect as if it were made under Article 53 of Regulation (EC) 178/2002.
