The Ivory Prohibitions (Exemptions) (Process and Procedure) Regulations 2022

Coming into force

The Secretary of State, in exercise of the powers conferred by sections 2(5), 3(1)(g) and (h), 4(7)(b) and (8)1, 5(5), 10(1)(f) and (g) and 39(1)(a) and (b) of the Ivory Act 2018 (“the Act”)2 and with the consent of the Welsh Ministers, the Scottish Ministers and the Northern Ireland department3 in accordance with section 39(3) of the Act, makes these Regulations.

The Secretary of State, in accordance with section 2(5) of the Act, being of the opinion that the institutions specified in the Schedule have the necessary knowledge and expertise to provide the Secretary of State with advice on applications for exemption certificates and having obtained the consent of the persons in charge of each institution to the prescription of that institution as able to provide such advice, in accordance with section 2(6) of the Act, prescribes those institutions as able to provide such advice to the Secretary of State.

The Secretary of State has consulted the Welsh Ministers, the Scottish Ministers and the Northern Ireland department in accordance with the requirements of section 39(4) of the Act before making regulations which prescribe a fee.
