The River Tyne (Tunnels) (Modification) Order 2023

Made

7th February 2023

Coming into force

28th February 2023

An application has been made to the Secretary of State in accordance with the Transport and Works (Applications and Objections Procedure) (England and Wales) Rules 2006(1) for an Order under sections 3 and 5 of the Transport and Works Act 1992(2) (“the 1992 Act”).

The Secretary of State, having considered the objections made and not withdrawn, has determined to make an Order giving effect to the proposals comprised in the application with modifications which in the opinion of the Secretary of State do not make any substantial change in the proposals.

The Secretary of State is of the opinion that the primary object of this Order cannot be achieved by means of an Order under the Harbours Act 1964(3).

The Secretary of State, having considered representations duly made under section 13 of the 1992 Act, has determined to make the Order applied for with modifications.

Notice of the Secretary of State’s determination was published in the London Gazette on 10th February 2023.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order modifies the River Tyne (Tunnels) Order 2005 to make consequential amendments required as a result of the adoption of a system for free-flow of traffic through the tunnels (without stopping at toll-booths).

In particular, the Order—

(a)omits references predicated on payment at toll-booths;

(b)makes provision about tunnel staff;

(c)provides for toll exemptions for coastguard vehicles; and

(d)provides for toll exemptions for disabled persons to be provided through a scheme for the registration of vehicles for exemption.

This Order does not authorise the carrying out of works or the acquisition of land (whether compulsorily or by agreement).

(2)

1992 c. 42. There are amendments to sections 3 and 5 which are not relevant to this Order.
