Coming into force

An application has been made to the Secretary of State in accordance with the Transport and Works (Applications and Objections Procedure) (England and Wales) Rules 20061 for an Order under sections 1 and 5 of the Transport and Works Act 19922 (“the 1992 Act”).

The Secretary of State has determined to make an Order giving effect to the proposals comprised in the application with modifications which in the opinion of the Secretary of State do not make any substantial change in the proposals.

The Secretary of State, in exercise of the powers conferred by sections 1 and 5 of, and paragraphs 4 and 7 of Schedule 1 to, the 1992 Act, makes the following Order—

Citation, commencement and interpretation

This Order may be cited as the Network Rail (Essex and Others Level Crossing Reduction) (Amendment) Order 2023 and comes into force on 11th May 2023.

In this Order, “the 2022 Order” means the Network Rail (Essex and Others Level Crossing Reduction) Order 20223.

Amendments to the 2022 Order3

The 2022 Order is amended as follows.

In Part 1 of Schedule 2, in the entry for the Parish of Boreham, in column (3)—

a

for “P163, P164, P165 and P166” substitute “P163 and P164”; and

b

for “P163, P167, P165, P166 and P162” substitute “P163, P167 and P165”.

In Schedule 5, in the entry for the Parish of Thorley—

a

in column (2), omit “32”; and

b

in column (3) omit “Access”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Network Rail (Essex and Others Level Crossing Reduction) Order 2022 which conferred powers on Network Rail to close or downgrade the level crossings specified in Schedule 2 and for the permanent acquisition of and temporary use of land in connection with the construction of public rights of way and other works in the highway required in connection with the level crossing changes. This Order clarifies the extent of stopping up of Footpath EX/213/24 (Boreham) (Schedule 2) and removes Plot 32 from Schedule 5 which is no longer needed for access.
