Coming into force

The Secretary of State makes these Regulations in exercise of the powers conferred by section 2(1) of the Carer's Leave Act 20231.

Citation Commencement and Extent1

These Regulations may be cited as the Carer's Leave (Consequential Amendments to Subordinate Legislation) Regulations 2024.

The Regulations come into force on 6th April 2024.

An amendment made by these Regulations has the same extent as the provision to which it relates.

Otherwise, these Regulations extend to England and Wales and Scotland.

The Working Time Regulations 19982

The Working Time Regulations 19982 are amended as follows.

In regulation 2(1) (interpretation) in the definition of “statutory leave” after “Part 8” insert “and Part 8B”.

Working Tax Credit (Entitlement and Maximum Rate) Regulations 20023

The Working Tax Credit (Entitlement and Maximum Rate) Regulations 20023 are amended as follows.

In regulation 4 (entitlement to basic element of Working Tax Credit: qualifying remunerative work)—

a

in sub-paragraph (4)(c) after “Schedule 7 of the Coronavirus Act 2020,” omit “and”;

b

in paragraph (4)(d)(ii) after “consequence of coronavirus” for “.” substitute “, and”;

c

after paragraph (4)(d)(ii) insert—

any period of absence from work due to taking carer’s leave under section 80J of the Employment Rights Act 19964,

Teachers’ Pension Scheme Regulations 20146

  • carer’s leave” means leave under section 80J of the Employment Rights Act 1996;

b

in the definition of “non-pensionable family leave”—

after “parental bereavement leave” substitute “or” for “,”;

after “paternity leave” insert “carer’s leave”.

Explanatory Note

These Regulations make amendments to secondary legislation in consequence of the Carer's Leave Act 2023, which makes provision for entitlement to carer’s leave.

These Regulations are part of a package of legislation to bring the statutory right to carer’s leave into effect.
