The National Assembly for Wales, in the exercise of the powers conferred on it by section 9(2) and (3) of the Adoption Act 1976(1) hereby makes the following Regulations:—
1.—(1) These Regulations may be cited as the Adoption Agencies (Amendment) (Wales) Regulations 2003 and shall come into force on 11th December 2003.
(2) These Regulations apply to Wales.
2. In regulation 5A of the Adoption Agencies Regulations 1983(2) (tenure of office of members), after paragraph (1), there is inserted —
“(1A) Where —
(a)a member of an adoption panel holds office and is in his second consecutive term as a member of that panel; and
(b)his term of office is due to expire on or after 31st December 2003,
the adoption agency may extend the term of office of that member for a further period not exceeding two years.”.

These Regulations amend the Adoption Agencies Regulations 1983 (“the 1983 Regulations”) and apply to Wales.
Regulation 2 amends regulation 5A of the 1983 Regulations to provide that an adoption agency may extend the term of office of a member of an adoption panel whose term of office is his second consecutive term of office and is due to expire on or after 31st December 2003 for a further period of two years.
These Regulations do not impose a cost on business.
1976 c. 36. Section 9(2) of the Adoption Act 1976 (“the 1976 Act”) was amended by section 116 of, and paragraph 5(6)(a) of Schedule 4, to the Care Standards Act 2000 (c. 14). The powers in section 9(2) and (3) are exercisable by the “appropriate Minister” who is defined in section 9(5) of the 1976 Act in relation to Wales, as the National Assembly for Wales. Section 9(5) of the 1976 Act was inserted by section 139(2) of, and paragraph 4(1)(b) of Schedule 4 to, the Adoption and Children Act 2002 (c. 38).
