The Inspection of Education and Training (Amendment) (Wales) Regulations 2004

The National Assembly for Wales makes the following Regulations in exercise of the powers conferred on it by sections 77(2) and (4), 80(4), 83(9) and 84(5) of the Learning and Skills Act 20001.

Name, commencement and application1

These Regulations are called the Inspection of Education and Training (Amendment) (Wales) Regulations 2004 and come into force on 1st September 2004.

They apply only in relation to Wales.

Amendment of the Inspection of Education and Training (Wales) Regulations 20012

The Inspection of Education and Training (Wales) Regulations 20012 are amended as follows.

For regulation 2 substitute the following —

Inspections are to be conducted within —

a

six years of the date of the last inspection, or

b

where there has been no inspection, within six years of whichever is the earlier of—

i

the date of any assessment or inspection carried out under section 9(4) of the Further and Higher Education Act 19923;

ii

the date of establishment of an institution providing education and training to be inspected; or

iii

1st September 2004,

and then within each six year period of the date of the last inspection.

In regulation 3 —

a

for the number “55” substitute the number “70”, and

b

delete the words “ or, where it is necessary to provide a translation into Welsh or English, the period of 65 working days from that date”.

In regulation 4(1) —

a

for the number “40” substitute the number “50”, and

b

delete the words “or, where it is necessary to provide a translation into Welsh or English, the period of 50 working days” and the words “(in either case)”.

These Regulations amend the Inspection of Education and Training (Wales) Regulations 2001 so as to —

a

provide for inspections of specific education or training to be carried out within six years from whichever is the earlier of —

  • the date of the last inspection (under the Learning and Skills Act 2000 or the previous regime under the Further and Higher Education Act 1992),

  • the establishment of a new institution, or

  • 1 September 2004,

and then within each six year period from the date of the last inspection; and

b

change the period within which an inspection report must be made to 70 working days in every case, and the period within which an action plan must be published to 50 working days in every case.
