Title, commencement and application

1.  The title of these Regulations is the Street Works (Inspection Fees) (Wales) (Amendment) Regulations 2008. They come into force on 1 April 2008 and apply in relation to Wales.

Amendment to regulation 3 (inspection fees)

2.  The Street Works (Inspection Fees) (Wales) Regulations 2006(3) are amended in accordance with regulation 3.

3.  In regulation 3, in paragraphs (1) and (8), for “£21.00” substitute “£25.00”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Street Works (Inspection Fees) (Wales) Regulations 2006 so as to increase the fee payable by undertakers for inspections of their work by street authorities in Wales under regulation 3 of those Regulations.

The fee originally prescribed in the 2006 Regulations was £21. The fee was last altered in June 2007, to £24 and is now increased to £25.

The functions of the Secretary of State under sections 75 and 104(1) were transferred, so far as exercisable in relation to Wales, to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), article 2 and Schedule 1. Section 75 is prospectively substituted by section 58(2) of the Traffic Management Act 2004 (c. 18). The functions of the National Assembly for Wales under the said sections 75 and 104(1) were transferred to the Welsh Ministers by virtue of paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).
