Coming into force

The Welsh Ministers, in exercise of the powers conferred on the Secretary of State by sections 75 and 104(1) of the New Roads and Street Works Act 19911, and now vested in them2, make the following regulations:

Title, commencement and application1

The title of these Regulations is the Street Works (Inspection Fees) (Wales) (Amendment) Regulations 2009. They come into force on 1 April 2009 and apply in relation to Wales.

The Street Works (Inspection Fees) (Wales) Regulations 2006, as amended3 are further amended in accordance with regulation 3.

These Regulations amend the Street Works (Inspection Fees) (Wales) (Amendment) (No. 2) Regulations 2008 (“the 2008 Regulations”). The 2008 Regulations further amended the Street Works (Inspection Fees) (Wales) Regulations 2006 (“the 2006 Regulations”) so as to increase the fee payable by undertakers for inspections of their work by street authorities in Wales, under regulation 3 of the 2006 Regulations.

The fee originally prescribed in the 2006 Regulations was £21. The fee was altered to £24 in July 2007 by the Street Works (Inspection Fees) (Wales) (Amendment) Regulations 2007 (S.I. 2007 No.1713 (W.150)), and was increased to £25 by the 2008 Regulations. The fee is now further increased to £50.
