The Local Government Boundary Commission for Wales, having submitted to the Welsh Ministers, in accordance with sections 54(1A) and 58(1) of the Local Government Act 1972(1), a report dated June 2009 on a review of part of the boundary between the preserved counties of Powys and Mid Glamorgan, together with the proposals formulated by the Commission thereon;

And the Welsh Ministers having decided to give effect to these proposals without modification;

And more than six weeks having elapsed since these proposals were submitted to the Welsh Ministers;

The Welsh Ministers, in exercise of the powers conferred on the Secretary of State by section 58(2) and (4)(b) of the Local Government Act 1972 and now vested in them so far as exercisable in relation to Wales(2), make the following Order:

Title and commencement

1.  The title of this Order is The Preserved Counties of Powys and Mid Glamorgan (Changes in Area) Order 2010 and it comes into force on 1 April 2010.

Interpretation

2.  In this Order—

  • “the boundary map” (“y map ffiniau”) means the map marked “Map of the Preserved Counties of Powys and Mid Glamorgan (Changes in Area) Order 2010”.

3.  The part of the preserved county of Powys shown hatched on the boundary map is transferred to the preserved county of Mid Glamorgan.

Explanatory Note

(This note is not part of the Order)

Section 20 of the Local Government Act 1972 (as substituted by the Local Government (Wales) Act 1994) (“the 1994 Act”) provides that the counties in Wales as they existed immediately before the passing of the 1994 Act will continue in existence for certain purposes. They are called “preserved counties”.

This Order, made in accordance with section 58(2) and (4)(b) of the Local Government Act 1972, gives effect, without modification, to proposals by the Local Government Boundary Commission for Wales (“the Commission”) which reported in June 2009 on its review of part of the boundary between the preserved counties of Powys and Mid Glamorgan. The Commission’s report recommended a change to reflect the changes made by the Merthyr Tydfil and Powys (Areas) Order 2009 (S.I. No. 889 (W.78)) to the boundary, in the area of Pontsticill, between the County Borough of Merthyr Tydfil in the preserved county of Mid Glamorgan and the County of Powys in the preserved county of Powys.

The powers of the Secretary of State were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) and are now vested in the Welsh Ministers by virtue of paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).
