Mae Gweinidogion Cymru yn gwneud y Rheoliadau a ganlyn drwy arfer y pwerau a roddwyd iddynt gan adrannau 18(4), 203(9) a (10) o Ddeddf y Gwasanaeth Iechyd Gwladol (Cymru) 2006 a pharagraff 4 o Atodlen 3 iddi(1).
Enwi a chychwyn
1.—(1) Enw'r Rheoliadau hyn yw Rheoliadau Ymddiriedolaeth Gwasanaeth Iechyd Gwladol Iechyd Cyhoeddus Cymru (Aelodaeth a Gweithdrefn) (Diwygio) 2011.
(2) Daw'r Rheoliadau hyn i rym ar 23 Mehefin 2011.
Diwygio Rheoliadau Ymddiriedolaeth Gwasanaeth Iechyd Gwladol Iechyd Cyhoeddus Cymru (Aelodaeth a Gweithdrefn) 2009
2.—(1) Diwygir Rheoliadau Ymddiriedolaeth Gwasanaeth Iechyd Gwladol Iechyd Cyhoeddus Cymru (Aelodaeth a Gweithdrefn) 2009(2) fel a ganlyn.
(2) Yn rheoliad 1(2) (dehongli), hepgorer y diffiniad o “undeb llafur”.
(3) Yn rheoliad 5(1) (cyfarwyddwyr anweithredol), hepgorer is-baragraff (ch).
(4) Yn rheoliad 10 (terfynu deiliadaeth swydd cadeirydd a chyfarwyddwyr anweithredol), yn lle rheoliad 10(8), rhodder—
“Os bydd y cyfarwyddwr anweithredol y cyfeirir ato yn is-baragraff (c) o reoliad 5(1) yn peidio â bod yn un o aelodau neu o gyflogeion corff sector gwirfoddol yng Nghymru, bydd Gweinidogion Cymru'n terfynu ei benodiad yn gyfarwyddwr anweithredol.”.
(5) Ym mharagraff 2 o Atodlen 1 (gweithdrefnau ar gyfer penodi'r cadeirydd a chyfarwyddwyr anweithredol), yn lle “aelodau” rhodder “gyfarwyddwyr”.
(6) Ym mharagraff 2(2) o Atodlen 2 (rheolau ynghylch cyfarfodydd a thrafodion yr Ymddiriedolaeth), yn lle “yr aelodau” (llinell 3) rhodder “y cyfarwyddwyr” ac yn lle “aelodau” (llinell 7) rhodder “gyfarwyddwyr”.

Mae'r Rheoliadau hyn yn diwygio Rheoliadau Ymddiriedolaeth Gwasanaeth Iechyd Gwladol Iechyd Cyhoeddus Cymru (Aelodaeth a Gweithdrefn) 2009 (O.S. 2009/1385 (Cy.141) drwy symud ymaith y gofyniad ar gyfarwyddwyr anweithredol i gynnwys person sydd yn swyddog o undeb llafur neu gorff cynrychioliadol arall o gyflogeion sy'n cynrychioli staff Ymddiriedolaeth Gwasanaeth Iechyd Gwladol Iechyd Cyhoeddus Cymru.
Mae yna hefyd fân ddiwygiadau i reoliad 1(2) (dehongli), paragraff 2 o Atodlen 1 (gweithdrefnau ar gyfer penodi'r cadeirydd a chyfarwyddwyr anweithredol), a pharagraff 2(2) o Atodlen 2 (rheolau ynghylch cyfarfodydd a thrafodion yr Ymddiriedolaeth).
