Darpariaeth drosiannol

9.—(1) Mae'r rheoliad hwn yn gymwys —

(a)pan fo asiantaeth fabwysiadu wedi cyfeirio achos at y panel mabwysiadu cyn i'r Rheoliadau hyn ddod i rym, a

(b)pan fo'r achos yn dod o fewn rheoliad 17(2) o'r Prif Reoliadau.

(2) Mewn achos lle y mae'r wybodaeth a'r adroddiadau y cyfeirir atynt yn rheoliad 17(2D) o'r Prif Reoliadau wedi eu hanfon at y panel mabwysiadu ond bod y panel mabwysiadu heb gyfarfod i ystyried yr achos cyn i'r Rheoliadau hyn ddod i rym, rhaid i'r asiantaeth fabwysiadu dynnu'r wybodaeth a'r adroddiadau yn ôl oddi wrth y panel a mynd ati i wneud penderfyniad yn unol â rheoliad 19(1A) o'r Prif Reoliadau.

(3) Mewn achos lle y mae'r wybodaeth a'r adroddiadau y cyfeirir atynt yn rheoliad 17(2D) o'r Prif Reoliadau wedi eu hanfon at y panel mabwysiadu a bod y panel wedi cyfarfod i ystyried yr achos cyn i'r Rheoliadau hyn ddod i rym, a'i fod —

(a)wedi penderfynu pa argymhelliad i'w wneud ond heb gyfleu'r argymhelliad hwnnw i'r asiantaeth fabwysiadu, neu

(b)yn aros i gael rhagor o wybodaeth oddi wrth yr asiantaeth fabwysiadu yn unol â rheoliad 18(2)(b) o'r Prif Reoliadau, neu gyngor cyfreithiol yn unol â rheoliad 18(2)(c) o'r Prif Reoliadau,

rhaid i'r panel mabwysiadu fynd ati i wneud ei argymhelliad yn unol â rheoliad 18 o'r Prif Reoliadau, a rhaid i'r asiantaeth fabwysiadu ystyried yr argymhelliad hwnnw yn unol â rheoliad 19(1) o'r Prif Reoliadau, fel pe na bai'r Rheoliadau hyn wedi eu gwneud.
