1.—(1) The title of these Regulations is the Federation of Maintained Schools (Wales) (Amendment) Regulations 2021.
(2) These Regulations come into force on 4 February 2022.
2.—(1) The Federation of Maintained Schools (Wales) Regulations 2014(3) are amended as follows.
(2) In regulation 15 (teacher governors), in paragraph (4)—
(a)the words from “any person” to the end become sub-paragraph (a), and
(b)after that sub-paragraph insert—
“; or
(b)a federation that consists of only two schools.”
(3) In regulation 16 (staff governors), in paragraph (4)—
(a)the words from “any person” to the end become sub-paragraph (a), and
(b)after that sub-paragraph insert—
“; or
(b)a federation that consists of only two schools.”

These Regulations amend the Federation of Maintained Schools (Wales) Regulations 2014 (S.I. 2014/1132 (W. 111)).
These Regulations provide that for federations consisting of only two schools, a person may be elected as a teacher or staff governor despite working at the same federated school as a previous teacher or staff governor who served within the past two years.
The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.
2002 c. 32. Section 19(9) was inserted by section 19(1) and (2)(b) of the Education (Wales) Measure 2011 (nawm 7). Section 210(7) was amended by section 21(1) and (3)(c) of the Learner Travel (Wales) Measure 2008 (nawm 2). See section 212(1) for the definition of “regulations”.
These functions of the National Assembly for Wales were transferred to the Welsh Ministers by paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).
