The Welsh Ministers, in exercise of the powers conferred by sections 50(3) and 53(2) of the Agriculture Act 20201, make the following Regulations.

As required by Article 9 of Regulation (EC) No 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety2 there has been open and transparent public consultation during the preparation of these Regulations.

PART 1Introductory

Title, commencement and application1

The title of these Regulations is the Common Organisation of the Markets in Agricultural Products (Amendment) (Wales) Regulations 2022.

These Regulations come into force on 14 December 2022.

PART 2

Amendment of retained direct EU legislation

Amendment of Commission Regulation (EC) No 543/20082

Commission Regulation (EC) No 543/2008 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 as regards the marketing standards for poultrymeat3 is amended as follows.

In Article 1, for “Article 75(1)(g) of Regulation (EC) No 1308/2013” substitute “paragraph 17(1)(d) (poultry and poultrymeat) of Schedule 5 to the Agriculture Act 2020, excluding live poultry”.

Amendment of Commission Regulation (EC) No 617/20083

In Article 3(5) of Commission Regulation (EC) No 617/2008 laying down detailed rules for implementing Regulation (EC) No 1234/2007 as regards marketing standards for eggs for hatching and farmyard poultry chicks4, omit “75(3),”.

Amendment of Commission Implementing Regulation (EU) No 543/20114

Commission Implementing Regulation (EU) No 543/2011 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 in respect of the fruit and vegetables and processed fruit and vegetables sectors5 is amended as follows.

Amendment of domestic regulations

Amendment of the Marketing of Fresh Horticultural Produce (Wales) Regulations 20099

The Marketing of Fresh Horticultural Produce (Wales) Regulations 200912 are amended as follows.

in the definition of “marketing rules”, for “, 75 and 76” substitute “and 76 of Regulation (EU) 2013,”;

Amendment of the Eggs and Chicks (Wales) Regulations 201010

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations make amendments consequential on those amendments made by Part 4 of Schedule 7 to the Agriculture Act 2020 (c. 21).

The amendments relate to marketing standards and are made to both retained direct EU legislation and EU derived domestic legislation. The amendments either omit cross references to articles of Regulation (EU) No 1308/2013 (EUR 2013/1308) (“the CMO Regulation”) which have been disapplied by Part 4 of Schedule 7 to the Agriculture Act 2020, in some cases together with associated wording, or operate to substitute references to articles of the CMO Regulation with an appropriate reference to retained EU legislation or to the Agriculture Act 2020.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.
