The Welsh Ministers make these Regulations in exercise of the powers conferred on the Secretary of State by section 53(1) of the Local Government Finance Act 1988(1), and now vested in them(2).

Title and coming into force

1.—(1) The title of these Regulations is the Central Rating List (Wales) (Amendment) Regulations 2024.

(2) These Regulations come into force on 18 July 2024.

Amendments to the Central Rating List (Wales) Regulations 2005

2.  The Central Rating List (Wales) Regulations 2005(3) are amended in accordance with regulations 3 to 17.

3.  In regulation 7(1) (railway hereditaments), after “Network Rail Infrastructure Limited” insert “(registered with company number 02904587)”.

4.  In regulation 8 (communication hereditaments), in paragraphs (1)(a), (3) and (5)(b), for “British Telecommunications plc”, in each place it occurs, substitute “British Telecommunications Public Limited Company (registered with company number 01800000)”.

5.  In regulation 9 (national and regional gas hereditaments)—

(a)in paragraphs (1) and (3), for “Transco”, in each place it occurs, substitute “National Gas Transmission plc (registered with company number 02006000)”;

(b)in paragraph (5) omit ““Transco” means Transco plc and each subsidiary of National Grid Transco plc existing on 1 March 2005;” and the “and” after it.

6.  In regulation 11 (gas meter hereditaments)—

(a)in paragraphs (1) and (3), for “Transco”, in each place it occurs, substitute “National Gas Transmission plc (registered with company number 02006000)”;

(b)omit paragraph (4)(b) and the “and” after it.

7.  In Part 1 of the Schedule (railway hereditaments), in the first column (designated person), immediately after “Network Rail Infrastructure Limited” insert “(registered with company number 02904587)”.

8.  In Part 2 of the Schedule (communication hereditaments), in the first column (designated person)—

(a)for “British Telecommunications plc” substitute “British Telecommunications Public Limited Company (registered with company number 01800000)”;

(b)omit the following designated persons—

(i)“Cable and Wireless UK”;

(ii)“Energis Communications Limited”;

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Central Rating List (Wales) Regulations 2005 (“the 2005 Regulations”). The 2005 Regulations designate persons and prescribe, in relation to those persons, one or more descriptions of non-domestic hereditament. The amendments made by these Regulations reflect the change of name of certain designated persons, and remove those who are no longer liable for certain non-domestic hereditaments. Company numbers for each designated person are also inserted. The effect is to ensure the 2005 Regulations accurately reflect the designated persons and the corresponding descriptions of hereditaments on the Central Rating List for Wales.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.

The power conferred on the Secretary of State by section 53(1) of the Local Government Finance Act 1988 (c. 41), so far as exercisable in relation to Wales, was transferred to the National Assembly for Wales by virtue of article 2 of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), and transferred to the Welsh Ministers by virtue of section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006 (c. 32).
