Changes to Legislation

Nid yw newidiadau ac effeithiau sydd eto i'w gwneud gan y tîm golygyddol ond yn berthnasol wrth edrych ar y fersiwn ddiweddaraf neu fersiwn ragolygol o ddeddfwriaeth. Felly, nid oes modd eu gweld wrth edrych ar ddeddfwriaeth fel y mae ar bwynt penodol mewn amser. Er mwyn gweld yr wybodaeth 'Newidiadau i Ddeddfwriaeth' ar gyfer y ddarpariaeth hon ewch yn ôl i'r fersiwn ddiweddaraf gan ddefnyddio'r opsiynau yn y blwch 'Pa Fersiwn' uchod.

Diwallu anghenion plant am ofal a chymorthLL+C

37Dyletswydd i ddiwallu anghenion gofal a chymorth plentynLL+C

(1)Rhaid i awdurdod lleol ddiwallu anghenion plentyn am ofal a chymorth os caiff ei fodloni bod amodau 1 a 2, ac unrhyw amodau a bennir mewn rheoliadau, wedi eu cyflawni (ond gweler is-adrannau (5) a (6)).

(2)Amod 1 yw bod y plentyn yn ardal yr awdurdod lleol.

(3)Amod 2 yw—

(a)bod yr anghenion yn bodloni’r meini prawf cymhwystra, neu

(b)bod yr awdurdod lleol yn barnu ei bod yn angenrheidiol diwallu’r anghenion er mwyn amddiffyn y plentyn—

(i)rhag cael, neu rhag risg o gael, ei gam-drin neu ei esgeuluso, neu

(ii)rhag cael, neu rhag risg o gael, ei niweidio mewn modd arall.

(4)Os yw’r awdurdod lleol wedi ei hysbysu am blentyn o dan adran 120(2)(a) [F1neu o dan adran 85(1) o Ddeddf Plant 1989 (plant sy’n cael eu lletya gan awdurdodau iechyd ac awdurdodau addysg lleol)], rhaid iddo drin y plentyn fel un sydd o fewn ei ardal at ddibenion yr adran hon.

(5)Nid yw’r ddyletswydd o dan is-adran (1) yn gymwys i anghenion plentyn i’r graddau y mae’r awdurdod lleol wedi ei fodloni bod yr anghenion hynny yn cael eu diwallu gan deulu’r plentyn neu ofalwr.

(6)Nid yw’r adran hon yn gymwys i blentyn sy’n derbyn gofal gan—

(a)awdurdod lleol,

(b)awdurdod lleol yn Lloegr,

(c)awdurdod lleol yn yr Alban, neu

(d)ymddiriedolaeth Iechyd a Gofal Cymdeithasol.

38Pŵer i ddiwallu anghenion gofal a chymorth plentynLL+C

(1)Caiff awdurdod lleol ddiwallu anghenion plentyn am ofal a chymorth os yw’r plentyn—

(a)o fewn ardal yr awdurdod lleol, neu

(b)yn preswylio fel arfer o fewn ardal yr awdurdod, ond y tu allan i’w ardal,

(ond gweler is-adran (4)).

(2)Os yw awdurdod lleol yn diwallu o dan is-adran (1) anghenion plentyn sy’n preswylio fel arfer o fewn ardal awdurdod lleol arall, rhaid iddo hysbysu’r awdurdod lleol y mae’r plentyn yn preswylio fel arfer yn ei ardal ei fod yn gwneud hynny.

(3)Mae gan awdurdod lleol bŵer i ddiwallu anghenion o dan yr adran hon p’un a yw wedi cwblhau asesiad ai peidio o anghenion yn unol â Rhan 3 neu asesiad ariannol yn unol â Rhan 5.

(4)Nid yw’r adran hon yn gymwys i blentyn sy’n derbyn gofal gan—

(a)awdurdod lleol,

(b)awdurdod lleol yn Lloegr,

(c)awdurdod lleol yn yr Alban, neu

(d)ymddiriedolaeth Iechyd a Gofal Cymdeithasol.

(1)Mae’r adran hon yn gymwys i blentyn—

(a)sydd o fewn ardal awdurdod lleol,

(b)y mae’r awdurdod lleol o’r farn bod ganddo anghenion am ofal a chymorth yn ychwanegol at y gofal a’r cymorth sy’n cael eu darparu gan deulu’r plentyn,

(c)sy’n byw ar wahân i’w deulu, a

(d)nad yw’n derbyn gofal gan yr awdurdod lleol.

(2)Os yw’r awdurdod lleol o’r farn ei bod yn angenrheidiol gwneud hynny er mwyn hyrwyddo llesiant y plentyn, rhaid iddo gymryd unrhyw gamau sy’n rhesymol ymarferol er mwyn—

(a)galluogi’r plentyn i fyw gyda’i deulu, neu

(b)hyrwyddo cyswllt rhwng y plentyn a’i deulu.
