Rydych yn edrych ar yr eitem hon o ddeddfwriaeth fel yr oedd ar bwynt penodol mewn amser. Mae fersiwn ddiweddarach o hyn neu ddarpariaeth, gan gynnwys newidiadau ac effeithiau dilynol, yn disodli'r fersiwn hon.
Sylwer bod y term darpariaeth yn cael ei ddefnyddio i ddisgrifio elfen ddiffiniadwy mewn darn o ddeddfwriaeth sy'n cael effaith ddeddfwriaethol – fel Rhan, Pennod neu adran.
Deddf Gwasanaethau Cymdeithasol a Llesiant (Cymru) 2014, Adran 118 yn gyfredol gyda’r holl newidiadau y gwyddys eu bod mewn grym ar neu cyn 16 Ionawr 2025. Mae newidiadau a all gael eu dwyn i rym yn y dyfodol. Mae newidiadau a wnaed yn ymddangos yn y cynnwys a chyfeirir atynt trwy anodiadau.
Nid yw newidiadau ac effeithiau sydd eto i'w gwneud gan y tîm golygyddol ond yn berthnasol wrth edrych ar y fersiwn ddiweddaraf neu fersiwn ragolygol o ddeddfwriaeth. Felly, nid oes modd eu gweld wrth edrych ar ddeddfwriaeth fel y mae ar bwynt penodol mewn amser. Er mwyn gweld yr wybodaeth 'Newidiadau i Ddeddfwriaeth' ar gyfer y ddarpariaeth hon ewch yn ôl i'r fersiwn ddiweddaraf gan ddefnyddio'r opsiynau yn y blwch 'Pa Fersiwn' uchod.
(1)Pan fo’n ymddangos i awdurdod lleol bod person ifanc—
(a)y mae ganddo ddyletswydd i gadw mewn cysylltiad ag ef o dan adran 105,
(b)y mae wedi bod yn cynghori ac yn cyfeillio o dan adran 114 neu 115, neu
(c)y mae wedi bod yn rhoi cymorth arall iddo o dan adran 114 neu 115,
yn bwriadu byw, neu yn byw, yn ardal awdurdod lleol arall neu awdurdod lleol yn Lloegr, rhaid iddo hysbysu’r awdurdod arall hwnnw.
(2)Pan fo plentyn sy’n cael ei letya yng Nghymru—
(a)gan sefydliad gwirfoddol neu mewn cartref preifat i blant,
(b)gan neu ar ran unrhyw Fwrdd Iechyd Lleol neu Awdurdod Iechyd Arbennig,
(c)gan neu ar ran grŵp comisiynu clinigol neu Fwrdd Comisiynu’r Gwasanaeth Iechyd Gwladol,
(d)gan neu ar ran awdurdod lleol wrth arfer swyddogaethau addysg,
(e)gan neu ar ran awdurdod lleol yn Lloegr wrth arfer swyddogaethau addysg,
(f)mewn unrhyw gartref gofal neu ysbyty annibynnol, neu
(g)mewn unrhyw lety a ddarperir gan neu ar ran Ymddiriedolaeth GIG neu gan neu ar ran Ymddiriedolaeth Sefydledig GIG,
yn peidio â chael ei letya felly mwyach ar ôl cyrraedd 16 oed, rhaid i’r person y cafodd y plentyn ei letya ganddo neu ar ei ran neu sy’n rhedeg neu’n rheoli’r cartref neu’r ysbyty (yn ôl y digwydd) hysbysu’r awdurdod lleol neu’r awdurdod lleol yn Lloegr y mae’r plentyn yn bwriadu byw yn ei ardal.
(3)Dim ond os yw’r llety wedi cael ei ddarparu am gyfnod o dri mis yn olynol o leiaf y bydd is-adran (2) yn gymwys yn rhinwedd paragraffau (b) i (g).
(4)Mewn achos lle y cafodd plentyn ei letya gan neu ar ran awdurdod lleol, neu awdurdod lleol yn Lloegr, wrth arfer swyddogaethau addysg, nid yw is-adran (2) yn gymwys oni fo’r awdurdod a fu’n lletya’r plentyn yn wahanol i’r awdurdod y mae’r plentyn yn bwriadu byw yn ei ardal.
