Deddf Gwasanaethau Cymdeithasol a Llesiant (Cymru) 2014, Adran 120 yn gyfredol gyda’r holl newidiadau y gwyddys eu bod mewn grym ar neu cyn 17 Hydref 2024. Mae newidiadau a all gael eu dwyn i rym yn y dyfodol. Mae newidiadau a wnaed yn ymddangos yn y cynnwys a chyfeirir atynt trwy anodiadau.
Nid yw newidiadau ac effeithiau sydd eto i'w gwneud gan y tîm golygyddol ond yn berthnasol wrth edrych ar y fersiwn ddiweddaraf neu fersiwn ragolygol o ddeddfwriaeth. Felly, nid oes modd eu gweld wrth edrych ar ddeddfwriaeth fel y mae ar bwynt penodol mewn amser. Er mwyn gweld yr wybodaeth 'Newidiadau i Ddeddfwriaeth' ar gyfer y ddarpariaeth hon ewch yn ôl i'r fersiwn ddiweddaraf gan ddefnyddio'r opsiynau yn y blwch 'Pa Fersiwn' uchod.
(1)Mae is-adran (2) yn gymwys pan fo llety’n cael ei ddarparu i blentyn yng Nghymru gan Fwrdd Iechyd Lleol, Ymddiriedolaeth GIG neu awdurdod lleol wrth arfer swyddogaethau addysg (“yr awdurdod lletya”)—
(a)am gyfnod olynol o 3 mis o leiaf, neu
(b)gyda’r bwriad, ar ran yr awdurdod, o letya’r plentyn am y cyfnod hwnnw.
(2)Rhaid i’r awdurdod lletya hysbysu swyddog priodol yr awdurdod cyfrifol—
(a)ei fod yn lletya’r plentyn, a
(b)pan fo’n rhoi’r gorau i letya’r plentyn.
(3)Yn yr adran hon, ystyr “yr awdurdod cyfrifol” ac “yr awdurdod sy’n gyfrifol” yw—
(a)yr awdurdod lleol neu awdurdod lleol yn Lloegr y mae’n ymddangos i’r awdurdod lletya mai’r awdurdod hwnnw yw’r un lle yr oedd y plentyn yn preswylio fel arfer yn union cyn iddo gael ei letya, neu
(b)pan fo’n ymddangos i’r awdurdod lletya nad oedd plentyn yn preswylio fel arfer o fewn ardal unrhyw awdurdod lleol neu awdurdod lleol yn Lloegr, yr awdurdod lleol ar gyfer yr ardal y mae’r llety wedi ei leoli ynddi.
(4)Yn yr adran hon ac yn adrannau 121 a 122 ystyr “swyddog priodol” yw—
(a)mewn perthynas ag awdurdod lleol, ei gyfarwyddwr gwasanaethau cymdeithasol, a
(b)mewn perthynas ag awdurdod lleol yn Lloegr, ei gyfarwyddwr gwasanaethau plant.
(5)Pan fo swyddog priodol awdurdod lleol wedi ei hysbysu o dan yr adran hon [F1, neu o dan adran 85 o Ddeddf Plant 1989 (asesu plant sy’n cael eu lletya gan awdurdodau iechyd ac awdurdodau addysg)], rhaid i’r awdurdod—
(a)asesu’r plentyn o dan adran 21, a
(b)ystyried i ba raddau (os o gwbl) y dylai arfer unrhyw un neu rai o’i swyddogaethau eraill o dan y Ddeddf hon, neu unrhyw un neu rai o’i swyddogaethau o dan Ddeddf Plant 1989, mewn cysylltiad â’r plentyn.
(6)Nid yw’r ddyletswydd o dan is-adran (5)(a) yn gymwys mewn perthynas â phlentyn sy’n derbyn gofal gan—
(a)awdurdod lleol,
(b)awdurdod lleol yn Lloegr,
(c)awdurdod lleol yn yr Alban, neu
(d)ymddiriedolaeth Iechyd a Gofal Cymdeithasol.
