Deddf Gwasanaethau Cymdeithasol a Llesiant (Cymru) 2014, Adran 127 yn gyfredol gyda’r holl newidiadau y gwyddys eu bod mewn grym ar neu cyn 16 Ionawr 2025. Mae newidiadau a all gael eu dwyn i rym yn y dyfodol. Mae newidiadau a wnaed yn ymddangos yn y cynnwys a chyfeirir atynt trwy anodiadau.
Nid yw newidiadau ac effeithiau sydd eto i'w gwneud gan y tîm golygyddol ond yn berthnasol wrth edrych ar y fersiwn ddiweddaraf neu fersiwn ragolygol o ddeddfwriaeth. Felly, nid oes modd eu gweld wrth edrych ar ddeddfwriaeth fel y mae ar bwynt penodol mewn amser. Er mwyn gweld yr wybodaeth 'Newidiadau i Ddeddfwriaeth' ar gyfer y ddarpariaeth hon ewch yn ôl i'r fersiwn ddiweddaraf gan ddefnyddio'r opsiynau yn y blwch 'Pa Fersiwn' uchod.
(1)Caiff swyddog awdurdodedig wneud cais i ynad heddwch am orchymyn (“gorchymyn amddiffyn a chynorthwyo oedolyn”) mewn perthynas â pherson sy’n byw mewn unrhyw fangre o fewn ardal awdurdod lleol.
(2)Dibenion gorchymyn amddiffyn a chynorthwyo oedolyn yw—
(a)galluogi’r swyddog awdurdodedig ac unrhyw berson arall sydd gyda’r swyddog i gael sgwrs breifat gyda’r person yr amheuir ei fod yn oedolyn sy’n wynebu risg,
(b)galluogi’r swyddog awdurdodedig i ganfod a yw’r person hwnnw’n gwneud penderfyniadau o’i wirfodd, ac
(c)galluogi’r swyddog awdurdodedig i asesu’n iawn a yw’r person yn oedolyn sy’n wynebu risg ac i wneud penderfyniad fel sy’n ofynnol gan adran 126(2) ynghylch pa gamau, os o gwbl, y dylid eu cymryd.
(3)Pan fo gorchymyn amddiffyn a chynorthwyo oedolyn mewn grym, caiff y swyddog awdurdodedig, cwnstabl ac unrhyw berson penodedig arall sydd gyda’r swyddog hwnnw yn unol â’r gorchymyn, fynd i mewn i’r fangre a bennir yn y gorchymyn at y dibenion a nodir yn is-adran (2).
(4)Caiff yr ynad heddwch wneud gorchymyn amddiffyn a chynorthwyo oedolyn os yw wedi ei fodloni—
(a)bod gan y swyddog awdurdodedig sail resymol dros amau bod y person yn oedolyn sy’n wynebu risg,
(b)ei bod yn angenrheidiol i’r swyddog awdurdodedig gael gweld y person er mwyn asesu’n iawn a yw’r person hwnnw’n oedolyn sy’n wynebu risg a gwneud penderfyniad fel sy’n ofynnol gan adran 126(2) ynghylch pa gamau, os o gwbl, y dylid eu cymryd,
(c)bod gwneud gorchymyn yn angenrheidiol er mwyn cyflawni’r dibenion a nodir yn is-adran (2), a
(d)na fydd arfer y pŵer mynediad a roddir gan y gorchymyn yn peri i’r oedolyn fod mewn mwy o berygl o gael ei gam-drin neu ei esgeuluso.
(5)Rhaid i orchymyn amddiffyn a chynorthwyo oedolyn—
(a)pennu’r fangre y mae’r gorchymyn yn ymwneud â hi;
(b)darparu y caiff cwnstabl fod gyda’r swyddog awdurdodedig;
(c)pennu’r cyfnod pryd y bydd y gorchymyn mewn grym.
(6)Caniateir i amodau eraill gael eu gosod ar orchymyn amddiffyn a chynorthwyo oedolyn, er enghraifft—
(a)pennu cyfyngiadau ar yr amser pan ganiateir i’r pŵer mynediad a roddir gan y gorchymyn gael ei arfer;
(b)darparu i berson penodedig arall fod gyda’r swyddog awdurdodedig;
(c)ei gwneud yn ofynnol i hysbysiad am y gorchymyn gael ei roi i feddiannydd y fangre a’r person yr amheuir ei fod yn oedolyn sy’n wynebu risg.
(7)Caiff cwnstabl sydd gyda’r swyddog awdurdodedig ddefnyddio grym rhesymol os yw’n angenrheidiol er mwyn cyflawni dibenion gorchymyn amddiffyn a chynorthwyo oedolyn fel a nodir yn is-adran (2).
(8)Wrth fynd i mewn i’r fangre yn unol â gorchymyn amddiffyn a chynorthwyo oedolyn rhaid i’r swyddog awdurdodedig—
(a)datgan diben yr ymweliad,
(b)dangos tystiolaeth o’r awdurdodiad i fynd i mewn i’r fangre, ac
(c)rhoi esboniad i feddiannydd y fangre am sut i gwyno ynghylch sut y mae’r pŵer mynediad wedi cael ei arfer.
(9)Yn yr adran hon ystyr “swyddog awdurdodedig” yw person sydd wedi ei awdurdodi gan awdurdod lleol at ddibenion yr adran hon, ond caiff rheoliadau osod cyfyngiadau ar y personau neu’r categorïau o bersonau y caniateir eu hawdurdodi.
