Deddf Gwasanaethau Cymdeithasol a Llesiant (Cymru) 2014, Adran 18 yn gyfredol gyda’r holl newidiadau y gwyddys eu bod mewn grym ar neu cyn 16 Ionawr 2025. Mae newidiadau a all gael eu dwyn i rym yn y dyfodol. Mae newidiadau a wnaed yn ymddangos yn y cynnwys a chyfeirir atynt trwy anodiadau.
Nid yw newidiadau ac effeithiau sydd eto i'w gwneud gan y tîm golygyddol ond yn berthnasol wrth edrych ar y fersiwn ddiweddaraf neu fersiwn ragolygol o ddeddfwriaeth. Felly, nid oes modd eu gweld wrth edrych ar ddeddfwriaeth fel y mae ar bwynt penodol mewn amser. Er mwyn gweld yr wybodaeth 'Newidiadau i Ddeddfwriaeth' ar gyfer y ddarpariaeth hon ewch yn ôl i'r fersiwn ddiweddaraf gan ddefnyddio'r opsiynau yn y blwch 'Pa Fersiwn' uchod.
(1)Rhaid i awdurdod lleol lunio a chynnal cofrestr o’r bobl sy’n preswylio fel arfer yn ardal yr awdurdod ac—
(a)sydd â nam ar eu golwg neu nam difrifol ar eu golwg,
(b)sydd â nam ar eu clyw neu nam difrifol ar eu clyw, neu
(c)sydd â nam ar eu golwg ac ar eu clyw sydd, gyda’i gilydd, yn cael effaith sylweddol ar eu bywydau bob dydd.
(2)Rhaid i’r gofrestr nodi, mewn cysylltiad â phob person sydd wedi ei gynnwys yn y gofrestr—
(a)y paragraff yn is-adran (1) y mae’r person hwnnw yn dod o’i fewn, a
(b)amgylchiadau ieithyddol y person.
(3)Caiff rheoliadau bennu, at ddibenion is-adran (1), gategorïau o bobl sydd i’w trin, neu nad ydynt i’w trin, fel pe baent yn dod o fewn paragraff (a), (b) neu (c) o’r is-adran honno.
(4)Rhaid i awdurdod lleol lunio a chynnal cofrestr o blant y mae is-adran (6) yn gymwys iddynt ac sydd o fewn ardal yr awdurdod lleol.
(5)Caiff awdurdod lleol lunio a chynnal cofrestr o oedolion y mae is-adran (6) yn gymwys iddynt ac sydd yn preswylio fel arfer yn ardal yr awdurdod lleol.
(6)Mae’r is-adran hon yn gymwys i berson—
(a)sy’n anabl,
(b)nad yw’n anabl ond y mae ganddo nam corfforol neu feddyliol sy’n arwain, neu y mae’r awdurdod yn barnu y gall yn y dyfodol arwain, at anghenion am ofal a chymorth, neu
(c)sy’n dod o fewn unrhyw gategori arall o bersonau y mae’r awdurdod yn barnu ei bod yn briodol ei gynnwys mewn cofrestr o bersonau y mae arnynt, neu y mae’r awdurdod yn ystyried y gall fod arnynt yn y dyfodol, anghenion am ofal a chymorth.
(7)O ran awdurdod lleol—
(a)caiff gategoreiddio pobl sydd wedi eu cynnwys mewn cofrestr o dan is-adran (4) neu (5) fel y gwêl yn dda, a
(b)rhaid iddo nodi amgylchiadau ieithyddol y bobl hynny yn y gofrestr berthnasol.
(8)Caniateir i’r cofrestrau a lunnir ac a gedwir o dan yr adran hon gael eu defnyddio wrth arfer swyddogaethau’r awdurdod; er enghraifft, er mwyn—
(a)cynllunio’r modd y mae’r awdurdod yn darparu gwasanaethau i ddiwallu anghenion am ofal a chymorth neu gymorth i ofalwyr, a
(b)monitro newidiadau dros amser yn nifer y bobl yn ardal yr awdurdod y mae arnynt anghenion am ofal a chymorth a’r mathau o anghenion sydd ganddynt hwy neu eu gofalwyr.
(9)Nid oes dim yn yr adran hon yn ei gwneud yn ofynnol i awdurdod lleol gynnwys unrhyw berson mewn cofrestr a gedwir o dan yr adran hon oni bai—
(a)bod y person wedi gwneud cais i gael ei gynnwys yn y gofrestr, neu
(b)bod cais i’w gynnwys felly wedi ei wneud ar ran y person.
(10)Pan fo awdurdod lleol yn cynnwys person mewn cofrestr a gedwir o dan yr adran hon—
(a)rhaid i’r awdurdod hysbysu’r person ei fod wedi ei gynnwys felly, a
(b)os gwneir cais gan y person neu ar ran y person, rhaid i’r awdurdod ddileu o’r gofrestr unrhyw ddata personol [F1(o fewn ystyr “ personal data ” yn Rhan 5 i 7 o Ddeddf Diogelu Data 2018 (gweler adran 3(2) a (14) o'r Ddeddf honno))] sy’n ymwneud â’r person hwnnw.
