Deddf Gwasanaethau Cymdeithasol a Llesiant (Cymru) 2014, Adran 21 yn gyfredol gyda’r holl newidiadau y gwyddys eu bod mewn grym ar neu cyn 05 Ionawr 2025. Mae newidiadau a all gael eu dwyn i rym yn y dyfodol. Mae newidiadau a wnaed yn ymddangos yn y cynnwys a chyfeirir atynt trwy anodiadau.
Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Cofnodir newidiadau ac effeithiau gan ein tîm golygyddol mewn rhestrau sydd i'w gweld yn yr adran 'Newidiadau i Ddeddfwriaeth'. Os nad yw'r effeithiau hynny wedi'u cymhwyso eto i destun y ddeddfwriaeth gan y tîm golygyddol maent hefyd wedi'u rhestru ochr yn ochr â'r ddeddfwriaeth yn y darpariaethau yr effeithir arnynt. Defnyddiwch y ddolen 'mwy' i agor y newidiadau a'r effeithiau sy'n berthnasol i'r ddarpariaeth rydych yn edrych arni.
Whole provisions yet to be inserted into this Act (including any effects on those provisions):
(1)Pan fo’n ymddangos i awdurdod lleol y gall fod angen gofal a chymorth ar blentyn yn ychwanegol at, neu yn lle, y gofal a’r cymorth sy’n cael eu darparu gan deulu’r plentyn, rhaid i’r awdurdod asesu—
(a)a oes angen gofal a chymorth o’r math hwnnw ar y plentyn, a
(b)os oes, beth yw’r anghenion hynny.
(2)Mae’r ddyletswydd o dan is-adran (1) yn gymwys o ran—
(a)plentyn sy’n preswylio fel arfer yn ardal yr awdurdod, a
(b)unrhyw blentyn arall sydd o fewn ardal yr awdurdod.
(3)Mae’r ddyletswydd o dan is-adran (1) yn gymwys ni waeth beth fo barn yr awdurdod lleol—
(a)ar lefel anghenion y plentyn am ofal a chymorth, neu
(b)ar lefel adnoddau ariannol y plentyn [F1neu unrhyw berson a chanddo gyfrifoldeb rhiant dros y plentyn].
(4)Wrth wneud asesiad o anghenion o dan yr adran hon, rhaid i’r awdurdod lleol—
(a)asesu anghenion datblygiadol y plentyn,
(b)ceisio canfod y canlyniadau—
(i)y mae’r plentyn yn dymuno eu sicrhau, i’r graddau y mae’n barnu ei bod yn briodol o roi sylw i oedran a dealltwriaeth y plentyn,
(ii)y mae’r personau a chanddynt gyfrifoldeb rhiant dros y plentyn yn dymuno eu sicrhau mewn perthynas â’r plentyn, i’r graddau y mae’n barnu ei bod yn briodol o roi sylw i’r angen am hyrwyddo llesiant y plentyn, a
(iii)y mae personau a bennir mewn rheoliadau (os oes rhai) yn dymuno eu sicrhau mewn perthynas â’r plentyn,
(c)asesu a allai darparu—
(i)gofal a chymorth,
(ii)gwasanaethau ataliol, neu
(iii)gwybodaeth, cyngor neu gynhorthwy,
gyfrannu at sicrhau’r canlyniadau hynny neu fel arall ddiwallu’r anghenion hynny, ac os felly, i ba raddau,
(d)asesu a allai materion eraill gyfrannu at sicrhau’r canlyniadau hynny neu fel arall ddiwallu’r anghenion hynny, ac os felly, i ba raddau, ac
(e)ystyried unrhyw amgylchiadau eraill sy’n effeithio ar lesiant y plentyn.
(5)Rhaid i awdurdod lleol, wrth iddo wneud asesiad o anghenion o dan yr adran hon, gynnwys—
(a)y plentyn, a
(b)unrhyw berson sydd â chyfrifoldeb rhiant dros y plentyn.
(6)Natur yr asesiad o anghenion sy’n ofynnol gan yr adran hon yw un y mae’r awdurdod lleol yn barnu ei fod yn gymesur o dan yr amgylchiadau, yn ddarostyngedig i unrhyw ofyniad mewn rheoliadau o dan adran 30.
(7)At ddibenion is-adran (1) rhagdybir bod angen gofal a chymorth ar blentyn anabl yn ychwanegol at, neu yn lle, y gofal a’r cymorth sy’n cael eu darparu gan deulu’r plentyn.
(8)Nid yw’r adran hon yn gymwys i blentyn sy’n derbyn gofal gan—
(a)awdurdod lleol,
(b)awdurdod lleol yn Lloegr,
(c)awdurdod lleol yn yr Alban, neu
(d)ymddiriedolaeth Iechyd a Gofal Cymdeithasol.
