36Pŵer i ddiwallu anghenion gofal a chymorth oedolyn

(1)Caiff awdurdod lleol ddiwallu anghenion oedolyn am ofal a chymorth os yw’r oedolyn—
(a)yn ardal yr awdurdod lleol, neu
(b)yn preswylio fel arfer yn ardal yr awdurdod, ond y tu allan i’w ardal.
(2)Os yw awdurdod lleol yn diwallu o dan is-adran (1) anghenion oedolyn sy’n preswylio fel arfer mewn ardal awdurdod lleol arall, rhaid iddo hysbysu’r awdurdod lleol y mae’r oedolyn yn preswylio fel arfer yn ei ardal ei fod yn gwneud hynny.
(3)Mae gan awdurdod lleol bŵer i ddiwallu anghenion o dan yr adran hon p’un a yw wedi cwblhau asesiad o anghenion ai peidio yn unol â Rhan 3 neu asesiad ariannol yn unol â Rhan 5.
